That was really just Scheinin being Scheinin and he had a valid, if technical point (you can't "pre-emptively" activate emergency legislation, you have to have an immediate emergency, and there isn't one in the economy yet, there is only an immediate emergency regarding the pandemic). Ultimately the government decided not to propose pre-emptively adopting emergency statutes that would only be possible under an immediate economic emergency.
