No, that phrase is literally a component of the crime (at least here, and I assume by its inclusion, there as well). Even fully naked minors may be depicted if the work falls into one of those categories, because the law is against "child pornography" not "nude or near-nude children." The prosecution must prove that the work is pornographic in nature and I don't think anyone could make the case that's what happening here, even if one or more pedophiles get a boner.

Sharing one's perspective with the world is literally one of the definitions of art. Like, to be full on 'child porn' you have be making, you know, porn with kids, as in there's no real point to it other than getting the audience off, and it's a rough argument to make that a movie ending with the main character bursting into to tears in front of a shocked and disgusted audience is meant to give people a boner.

yea I'm looking forward to the transcript of the obviously very normal and cool lawyer explaining how well OBVIOUSLY this movie about children is meant to be purely sexual as its primary function with nothing else to it, I mean just look at it, it's got, ya know, kids and...kids...and, you know...their bodies...the kids' bodies in outfits and all...I'm sorry what was the question?
