If you can point to a confirmed incident where someone got slapped with a $10 you-changed-your-phone fee, and was neither able to get out of it, nor cancel their contract sans ETF, then there's legitimacy to your complaint that Sprint's policy is that they can arbitrarily change the cost of your phone service with no recourse if that's unacceptable. I understand you have concern that by their "officially posted policy" they can jack up rates on you. But that sounds "materially adverse" to me. I guess we don't know which it is until someone tries and fails. ExcessBLarg! fucked around with this message at 22:23 on Sep 23, 2011 |

T-Mobile didn't get rid of EM+ you just have to call and ask for it. Or at least it worked when I switched to my own new plan in like March.

Honestly, I think it was foolish the way Sprint did it. They started out only charging the $10 premium data fee on 4G phones and then shifted it to all smartphones. They should have just said it's a new smartphone charge in the first place. I've had an account for 10 years. You mean to tell me I might be able to talk them out of the premium data fee? I've already got a retention plan that's a little better than what's offered. kylejack fucked around with this message at 22:25 on Sep 23, 2011 |

There is no perfect way to do it, but I'd bet it was a mixture of not wanting to kill Christmas sales and probably more they didn't think they would have too and then later went "oh poo poo, we need more money." Sprint does that a lot. What phone are you getting? Some phones Sprint MIGHT let you by, but as time goes on they are less and less giving on it, and it probably depends on whatever they deem your net value. You can always try. Official policy is to waive the $10 fee if the equipment change is as a result of a warranty or insurance replacement. Maybe that little FYI helps some of you legal eagles figure out the legitimacy of the smartphone fee. Ultimately, it seems like a drawback of a CDMA network--no SIM cards. You can't swap devices without going through Sprint. Even if you do the ESN swap on the webpage, they can still present a splash page that forces you to agree to the fee as a condition of changing existing equipment.

I suppose the one benefit of the GSM carriers is the customer expectation of open handset use, so if you bring in a device AT&T doesn't know about, then you can use it on any kind of plan. Also, I don't think AT&T has to allow any device onto its network, and they could easily be just as restrictive as Verizon and Sprint are. That kind of open access requirement is something that really should be regulated. Thanks to Google, it is in the 700 band, so we'll see how that work.

Does anyone have a good idea why the loving camera sucks so much dick on the evo 3d? Slowest shutter speed ever. Useless if you are trying to take pictures of something that doesn't stay still like an animal. And that is if you don't try to take multiple pictures in a row, the loving thing locks up. Happens with my dad's new evo 3d along with mine.

Or maybe a different ROM? Big mean giraffe recommended clean Rom to me, and performance is just overall faster now. Just a thought.

Manufacturers have the camera sound so that you can't take stealth photos of unsuspecting victims. I think in some countries (voyeurism-obsessed Japan) it's a legal requirement.

I called Sprint on the 11th and they set up my advanced exchange. It's now the 24th and I haven't gotten it. I called and spoke to some friendly reps for once, and they said it hasn't even been sent yet. 13 days later. What? They had to transfer me to a "specialist" and I waited 20 minutes on hold before I gave up and disconnected. Is this seriously normal for it to not even ship after 13 days? I'm calling Retentions. I'm sick of these delays and bullshit answers from their customer service number.
