I watched Weekend at Bernies 2 as a kid and thought throughout the whole movie that Bernie was played by Burt Reynolds because he was the only man I knew in Hollywood who had facial hair and I thought that everyone in every movie who had facial hair was Burt Reynolds. Like, Hollywood was only allowed to have one guy with a mustache at a time. And Burt inherited his role as Hollywood's sole mustache from previous mustached star, Tom Selleck.

Don't know if it's been mentioned in this thread yet, but saw a chain of tumblr links about it: Lexxy is currently campaigning a petition against Gaia Online for unlawfully plagarizing Homestuck in the form of purchasable in-game items that are near-exact copies of the kids' logos and the trolls' horn designs. Hmmmm, I'm actually a little curious how this is going to go. On one hand, Homestuck fans tore down Newgrounds in under fifteen minutes. On the other hand, Gaia is a shambling monstrosity of a forum that averages a million posts a day, most of them presumably terrible.

IANAL yet, but I am in law school and have taken Copyrights. This is not qualified legal advice, and should not be taken as a substitute for consultation with an actual qualified attorney who specializes in this field. As far as the bubbles go, the items in question are not parody, because they are not a commentary on the original work. Nor would they be considered "transformative" such that they would be considered a fair use. Whether the original works qualify as sufficiently original is a jury question, but one I'd expect Hussie to win, particularly because of the reproduction of the exact colors and the existence of the icons as a set. I think that he has a valid prima facie case, and that fair use does not apply (commercial use, non-transformative, the substance of the offending item is entirely composed of protected expression). However, I do wonder about whether a jury would be sympathetic; I don't have a great sense for how juries tend to break in this sort of case. The horns are a tougher case, because I'm not sure that an element of a character taken in isolation is sufficiently delineated to qualify as copyrightable.

Right, but "orangish gradient horns" is less distinctive than Mario's hat, and there were differences in the horns as compared to the trolls', while the bubbles were straight-up copying. I don't think Hussie has a copyright on all orangish gradient horns.
