http://boston.cbslocal.com/2013/05/01/police-3-additional-suspects-in-custody-in-boston-marathon-bombings-case/

WBZ has it:

quote:

BOSTON (CBS/AP) – Boston police say three additional suspects have been taken into custody in Boston Marathon bombings investigation.

Their names have not been released. Police said more details will be released later today.

Earlier today, lawyers for two men friendly with suspect Dzhokhar Tsarnaev said their clients have been extensively interviewed by federal investigators.

Azamat Tazhayakov and Dias Kadyrbayev, both originally from Kazakhstan, appeared via video for a visa violation hearing in immigration court in Boston on Wednesday.

They have been held in a county jail for more than a week on allegations that they violated their student visas while attending the University of Massachusetts Dartmouth with Dzhokhar Tsarnaev.

The marathon attack was not mentioned in court and their cases were continued.

Their attorneys said afterward that authorities have not indicated their clients had anything to do with the bombings. Federal authorities would not comment.

Attorney Robert Stahl said Tazhayakov and Kadyrbayev were drawn to Tsarnaev because he also spoke Russian.

And it sounds like they probably shouldn't have even mentioned the Boston Marathon in the first place, going by the latest updates.

Edit: Ah, here we go.

Update 12:58pm EDT: The two suspects from Kazakhstan are reported to be college friends of Dzhokhar Tsarnaev, according to the Associated Press. CBS Boston is reporting these two suspects' names to be "Azamat Tazhayakov and Dias Kadyrbayev", and goes on to say they will be charged with "conspiracy to obstruct justice and making false statements." The report does not provide the name of the third suspect, but goes on to say it is a male native to Massachusetts, who will be charged with making false statements. The actual names and charges have yet to be unsealed but when they are, we will update.

Washington Post posted:

Father of New York Post ‘Bag Man’ seeks legal counsel

El Houssein Barhoum is the father of one of the young men depicted on the April 18 cover of the New York Post. “Bag Men,” read the headline, with this explanation: “Feds seek these two pictured at Boston Marathon.”

“These two” had nothing to do with the Boston Marathon bombings, but they made the Post cover in any case. As a result, Barhoum is talking to lawyers about his options. “A lot of people, they tell me that’s your right to sue them,” says Barhoum, who says he is working toward a contract with a lawyer. “I will give him my case and he will study it.” The Erik Wemple Blog is already on record as favoring this approach.

Should the family file a civil complaint, it’ll surely address the upheaval that the New York Post has helped bring to the Barhoum household. The son in the photo, Salah Barhoum, a 16-year-old track athlete (other accounts say he’s 17), sleeps one or two hours per night these days, says El Houssein Barhoum, and sometimes “refuses to go to school.” “He says, ‘I don’t want people to ask me a lot of questions,’ ” the father reports.

Before the photo hit the New York Post, it circulated on the Internet, a scary development that prompted Salah Barhoum to meet with authorities to clear his name. That was on Wednesday, two days after the bombings. On Thursday, the Post chose to showcase Salah Barhoum and a friend.

Following all the attention, “We were just scared to go outside,” says El Houssein Barhoum, who says he works at a Cosi restaurant in Boston. On account of the sleepless nights he spends thinking about his kid, Barhoum says he’s been arriving late to work. “Recently, because usually I keep thinking about my son and about my family and in the morning, it’s hard for me to wake up early and I become lazy again,” says El Houssein Barhoum, who immigrated from Morocco with his family about eight years ago. “My future is based on my kids, so when you see your future is like really like the destruction of your kids’ future, so how can you feel? My capital is my kids. If something happens to them, it happens to me, too.”

Staffers from the New York Post, says El Houssein Barhoum, visited his home In Revere, Mass., on the same day that “Bag Men” appeared on the paper’s cover. “They come here at my home, check his real name and took some pictures,” he recalls. When asked if they’d apologized for the high-profile photograph, El Houssein Barhoum said they hadn’t. “If they won’t apologize, it’s not between me and the New York Post,” he says. “They should apologize on the newspaper. They should write something on the newspaper, not between us. If they make a bad image of your son, they should make a good image just to correct.”

The New York Post did publish a story saying that the kids had been “cleared.”

My guess is that they were asked to throw away potential evidence but did not tell that story to the authorities when questionsed, which was contradicted by what the FBI later wrung out of Dzhokhar.

Well they might have known they were destroying evidence unless they were really dumb but not be linked to bombing. He sold some drugs right? It could have been something like "That guy on TV looks like me and this laptop has evidence showing I sold/bought weed and these fireworks we were playing with are illegal so get rid of them."

I think the most embarrassing thing would be if they did it because there was a bunch of obviously pirated music, movies and TV shows on it, and they were trying to dodge a million-dollar lawsuit. Something related to weed would be a pretty close 2nd.

"Q: What is the penalty for obstruction?
A: Generally, federal obstruction of justice is punishable by up to five years in prison. If the obstruction occurs in connection with the trial of a federal criminal case, the defendant may be sentenced to either five years in prison, or the maximum sentence that could be imposed in the trial in which the obstruction occurred, whichever is greater. For example, if the obstruction occurs in connection with a drug trafficking case carrying a maximum penalty of 20 years in prison, the person who obstructed justice might receive 20 years in prison for obstructing justice. If the person who obstructed justice was also the defendant in the drug trafficking case, the obstruction sentence might be added to the drug trafficking sentence, for a maximum possible sentence of 40 years in prison."

Jesus, was I this stupid when I was 19?

quote:

BOSTON - Three college friends of Boston Marathon bombing suspect Dzhokhar Tsarnaev were arrested and accused Wednesday of removing a backpack containing fireworks emptied of gunpowder from Tsarnaev's dorm room three days after the attack to try to keep him from getting into trouble.

Azamat Tazhayakov and Dias Kadyrbayev were charged with conspiring to obstruct justice. A third man, Robel Phillipos, was charged with lying to investigators about the visit to Tsarnaev's room.

In court papers, the FBI said Tazhayakov and Kadyrbayev agreed to throw the backpack in the garbage — it was later found in a landfill by law enforcement officers — after concluding from news reports that Dzhokhar Tsarnaev was one of the bombers.

A court appearance for the three was scheduled for Wednesday afternoon. Their lawyers refused to comment ahead of the hearing.

Three people were killed and more than 260 injured on April 15 when two bombs exploded near the finish line. The suspect's brother, Tamerlan Tsarnaev, died after a gunfight with police days later. Dzhokhar Tsarnaev, a 19-year-old sophomore at the University of Massachusetts at Dartmouth, was captured and lies in a prison hospital.

Tazhayakov and Kadyrbayev, who are from Kazakhstan, have been held in jail for more than a week on allegations that they violated their student visas while attending UMass. All three men charged Wednesday began attending UMass with Tsarnaev at the same time in 2011, the according to the FBI.

The three were not accused of any direct involvement in the bombing itself. But in a footnote in the court papers outlining the charges, the FBI said that about a month before the bombing, Tsarnaev told Tazhayakov and Kadyrbayev that he knew how to make a bomb.

Authorities allege that on the night of April 18, after the FBI released photos of the bombing suspects and the three men suspected their friend was one of them, they went to Tsarnaev's dorm room. The men noticed a backpack containing fireworks, which had been opened and emptied of powder, the FBI said.

The FBI said that Kadyrbayev knew when he saw the empty fireworks that Tsarnaev was involved in the bombings and decided to remove the backpack from the room "in order to help his friend Tsarnaev avoid trouble." He also decided to remove Tsarnaev's laptop, the FBI said in court papers.

After the three men returned to Kadyrbayev's and Tazhayakov's apartment with the backpack and computer, they watched news reports featuring photographs of Tsarnaev.

The FBI affidavit said Kadyrbayev told authorities the three men then "collectively decided to throw the backpack and fireworks into the trash because they did not want Tsarnaev to get into trouble."

Kadyrbayev said he placed the backpack and fireworks along with trash from the apartment into a large trash bag and threw it into a garbage bin near the men's apartment.

According to the affidavit, all three were watching a movie at Tsarnaev's dormitory room (Tsarnaev wasn't there, his roommate was) when one of them noticed a backpack with the empty fireworks and then one of them realized that Tsarnaev was involved in the bombings. He then allegedly decided to get rid of the backpack in order to help their friend avoid trouble. He allegedly took the laptop because otherwise Tsarnaev's roommate would think that he was stealing or behaving suspiciously by just taking the backpack (????)

I believe he was told the items were from a robbery when he actually tossed them in the river but the next day he connected them to news stories of the murder, but didn't turn his friends in based on his suspicions. I think all together he'll do 5 years. I can't imagine these guys will get life, even if the courts can impose that sentence.
