I thought that the issue was more that the statement said this:

Given Gus has a right to appeal the decision to dismiss him, the club will not be making any further comment on this matter at this time.

So, who the hell knows. In all honesty, I can't see Poyet appealing this, because if he is reinstated, imagine the circus that surrounds it.

He did say his phone was off while he was at the BBC, and that legally he's not allowed to respond to contact from anyone at the club. They could have been proper scumbags and texted him 5 minutes before they released the announcement, it's obviously a hosed up situation that is being handled horrifically.
