He had an answer for this

Essentially, he is arguing that the cop should be acquitted under the Missouri law as it is on the books (because Garner didn't specifically overturn Missouri's law for the reason given above), and even though he believes the law is unconstitutional, that doesn't matter because it's the law now, and even though he thinks the Supreme Court would/should rule to overturn it, that doesn't matter because once the cop is acquitted the state can't appeal so it will never get to the Supreme Court anyway.

Michigan and Missouri are different states in different circuits. Does he have any caselaw that's actually relevant to the application of Garner in the Brown case?

Yeah I said that too, he just said it's persuasive even if it's not controlling so he thinks that the Missouri courts should acquit the cop even if Brown was trying to escape and the courts should keep doing that until either the legislature changes the law or one of these fleeing felon laws comes before the Supreme Court in a criminal context and get overturned.

Of course, this doesn't even get into the whole issue of whether it's reasonable for a cop in a police car to believe that deadly force is the only way to stop a man fleeing on foot in the street in broad daylight, but hey.

The editorial cartoon yesterday accompanied a Rich Lowry column about the unfortunate presence of looters and how that is not a legitimate form of protest. Provocative yes. Racist? Certainly not in intent.

Two people have shared this. Both white people who, as far as I know, do not listen to rap.

Stuff like this is really only posted by people who haven't listened to hip-hop since like 1992. Rappers have been calling out hatred and misogyny for years, of course every time Kanye publicly does so people just classify it as "another crazy Kanye rant". Plus when some white dude shoots a bunch of people, does anyone ever call on country artists to reign in their misogyny and lawlessness?

I want to post Killer Mike's CNN interview in the comments but I'm sure she will just focus on his name being Killer Mike.

Anytime people complain about rap, I always say "I was listening to the radio the other day and a horrible song came on. It was about being in prison and that he killed a man in Reno, just to watch him die" I can't believe that white people listen to that awful violent country music."

More violent gangster music:

quote:

Early one mornin' while makin' the rounds
I took a shot of cocaine and I shot my woman down
I went right home and I went to bed
I stuck that lovin' .44 beneath my head

Got up next mornin' and I grabbed that gun
Took a shot of cocaine and away I run
Made a good run but I run too slow
They overtook me down in Juarez, Mexico

Late in the hot joints takin' the pills
In walked the sheriff from Jericho Hill
He said Willy Lee your name is not Jack Brown
You're the dirty heck that shot your woman down

Said yes, oh yes my name is Willy Lee
If you've got a warrant just a-read it to me
Shot her down because she made me slow
I thought I was her daddy but she had five more

When I was arrested I was dressed in black
They put me on a train and they took me back
Had no friend for to go my bail
They slapped my dried up carcass in that county jail

Early next mornin' bout a half past nine
I spied the sheriff coming down the line
Up then he coughed as he cleared his throat
He said, "Come on you dirty heck into that district court"

Into the courtroom my trial began
Where I was handled by twelve honest men
Just before the jury started out
I saw that little judge commence to look about

In about five minutes in walked the man
Holding the verdict in his right hand
The verdict read in the first degree
I hollered, "Lawdy Lawdy, have mercy on me"

The judge he smiled as he picked up his pen
99 years in the Folsom pen
99 years underneath that ground
I can't forget the day I shot that bad bitch down

Come on you've gotta listen unto me
Lay off that whiskey and let that cocaine be

School shootings is cause of the music kids these days like. The droughts, floods and hurricanes caused by global warming are actually made by "the gays". Poverty traps are caused by welfare. "persuasive not controlling" is total bullshit- it's entirely up to the judge whether or not to cite to or rely on that rationale. It's not even a circuit court! I'd need to look at the Michigan case itself to see if it was a sane reading of Garner, but it would be a strange application of what I've read of the Garner decision.

This person is bending over backwards to make his argument seem like it's legally structured- it's very telling that he didn't start with "there's a decision out of Michigan that I think courts would use to say that the Missouri law is Constitutional and Brown's killing was legal".

It must also be noted that within the CSA constitution was a requirement that if a state decided to abolish slavery for their own reasons, they would have to go back to the Union or become a separate country, which I would call the exact opposite of State's Rights

CSA Constitution posted:

No bill of attainder, ex post facto law, or law denying or impairing the right of property in negro slaves shall be passed.
Not only did the Confederate Constitution make slavery legal, it made it unconstitutional for individual states to pass any laws which would infringe the right to own slaves. States literally had no right to outlaw slavery in the Confederacy.
