No, it's a tax on gains made on capital. Totally not a CGT.

Also, it was policy written up in about a month, according to Todd McClay on Newstalk ZB. Apparently tax policy is usually written out over 4~6 months.

"We hold rather that the Crown could not both withhold the memorandum and resist the appeal in the manner that it did. The effect was to mislead the Court.

"We are satisfied that there has been a serious error of process. It is, we accept, attributable to an error of judgment rather than misconduct."

The decision of the Court of Appeal comes three weeks after an urgent hearing held in Wellington where Mr Jones told the three appellate judges that Kim Dotcom's new statement was a "fantasy and a nonsense". The Queen's Counsel said the Crown made a "very serious error" by not disclosing the new material, known as the Butler memorandum, ahead of a previous Court of Appeal hearing last October.

The trial largely hinged on the credibility of who was right about a contentious lunch at the Dotcom mansion. Banks was convicted but his wife Amanda later unearthed new witnesses who corroborated their version of events, so the Court of Appeal quashed the conviction and ordered a retrial. However, in response to the evidence of the new witnesses, Dotcom said there was now two lunches - but this was not disclosed ahead of the appeal hearing.

In response for the Crown, the Solicitor-General Mike Heron, QC, said the retrial should stand and the new evidence was a matter for the trial judge to decide.

Mr Banks will hold a press conference this afternoon.

Results: cantankerous, folksy, still puffed-up about his Northland victory, said "not racist but" or equivalent so many times I lost count.

He's starting to show his age. Not an attack on the dude, but it's written all over him that the engine is winding down a little. It'll be interesting to see how that goes.

what's with the whole thing in politics where no one takes anything anyone else says reasonably? why is everything always taken to the extreme? including things in this thread, everyone takes what people say out of context, extrapolate them to the extreme. it's like no one is actually interested in the intention of what the other party were trying to do but instead take parts of their statements out of context and try to use that against them. do people fall for that poo poo? no party is immune to doing this. virtually no one has any credibility because no one talks about things in a reasonable sense. parliment is like watching fuckin children and reading about poo poo here aint much better.
