Ok you defend the State of Texas and I'll represent the Plaintiffs and we'll see who gets hosed.

I mean, are you going to point out what exactly about the AG opinion is a violation of the law? Because thus far, you haven't made a single coherent argument.

It just says that a county clerk or other county employee has a right to find another employee to issue SSM licenses if doing so violates their religious beliefs, in the same way the law protects any employee. It doesn't really deal with the answer of what happens if no one willing to do it can be found.

The full opinion is found here: https://www.texasattorneygeneral.gov/opinions/opinions/51paxton/op/2015/kp0025.pdf

It doesn't say that the counties shouldn't issue SSM licenses, or that clerks are allowed to refuse to let SSM licenses be issued in their country.

Frankly, if it's easier to go after the clerks I say do so. Win enough cases and other clerks will take notice.

Won't mean they'll comply, perhaps they'll find some new trick.

Most clerks are represented by district or county attorneys. In big counties, they'll be incredibly competent and will probably tell the clerks to issue licenses or face costly suits.

In small counties, there is a very large skill/resource gap of the county/district attorneys. They may get themselves in trouble. I'm thinking places like Childress, herford, Kermit, etc. Plus side: probably very few ssm requests there.

Man, went I went to work for a group of dirty hippie lawyers in like 2007 and everyone was pretty much in favor of Abbott the AG because he was making it a priority to allow single moms with no resources to go after their deadbeat exes. Now I seriously wonder if he will be a worse governor than Rick Motherfucking Perry.

Also I've clearly been in Texas way too long because somewhere in the deep recesses of my mind I halfway thought that things might be about to get better because even if we had to have a total shithead Texas Republican governor at least it would be a Longhorn instead of an Aggie.

Most of the big counties have started issuing them already anyway - unless by "big" you mean suburban stuff like Williamson or Bastrop.

I do. I suspect Williamson, Collin, and Denton will fall in line this week, because it'll cost a lot not to.

I'm thinking more of 10-20k counties, where there are some really bad lawyers on staffs, or only one or two for that matter.

Just for practical purposes, marriage law is statewide right? A marriage license from Travis county issued to a Denton county couple is still valid, correct? Not that people should have to drive three hours to get a marriage license because of shithead county officials, but people will still be able to exercise their rights even if they have to go to Dallas or Austin while we wait for rural and suburban counties to stop stomping their feet, right?

Yes, and any local institutions that wouldn't recognize the marriage license (I'm not really aware of any that use marriage licenses and aren't at least state-level) could easily be challenged in court.

Yeah hopefully they'll just realize that they aren't actually accomplishing anything by refusing to issue licenses to same sex couples and don't want the cost and headache of a lawsuit and give in to the inevitable course of history. It's just pure petulance.

First Same Sex Marriage License Issued in Denton County

A Denton County clerk issued the county's first same-sex marriage license Monday saying her oath to uphold the law trumps her objection to the practice on religious grounds.

"Same-sex marriage is in contradiction to my faith and belief that marriage is between one man and one woman," said Denton County Clerk Juli Luke. "However, first and foremost, I took an oath on my family bible to uphold the law as an elected public official. My personal belief cannot prevent me from issuing the licenses as required."

Hopefully the policing of gerrymandering ruling for Arizona can carry over into Texas because we need to stop that poo poo badly.

Also a shame the clean air ruling was boiled down to "clean air is too expensive". :smith: But yes! Hopefully a lot of the clinics down here, Rio Grande Valley, can stay open now because low income women's health is now pretty much translating into, traveling to Nuevo Progresso, or Reynosa, or Matamoros.

Y'all I'm afraid the Bluebell shutdown was just another plank in Obama's nefarious agenda for our fair and free state

quote:

Did the government shut down Blue Bell because of its two-part plan to both demoralize Texas and seize Blue Bell’s distribution centers and fleet of refrigerated trucks to use as “hidden-in-plain-sight” mobile morgues? And why did those trucks apparently have a military escort?

-However, the videos from DAHBOO777 and the Fugazi Report have COMPLETELY DESTROYED any credibility Blue Bell had remaining as ONCE AGAIN, we see Blue Bell Ice Cream trucks involved in the “Raider Focus” war games in Colorado, more proof that corporate America is lying to the American citizens as the United States Military prepares for SOMETHING HUGE in this country and as the 2nd video below clearly shows, whatever it is they are preparing for is MASSIVE as massive amounts of military hardware (and Blue Bell Ice Cream trucks) are seen on the streets of America. -

It is strange, the hospital vanilla blue bell ice cream was different than the actual stuff you bought at the store. I liked the hospital stuff and I don't really like the store bought stuff.

But yes, I enjoy that 1903 vanilla flavor that HEB puts out.

Paxton might be in some very serious trouble

quote:

The criminal investigation against Texas Attorney General Ken Paxton has taken a more serious turn, with special prosecutors now planning to present a first-degree felony securities fraud case against him to a Collin County grand jury, News 8 has learned.

Special prosecutor Kent Schaffer told News 8 Wednesday afternoon that the Texas Rangers uncovered new evidence during the investigation that led to the securities fraud allegations against the sitting attorney general.

"The Rangers went out to investigate one thing, and they came back with information on something else," Schaffer told News 8. "It's turned into something different than when they started."

Schaffer, a Houston criminal defense attorney, said the securities fraud allegations involve amounts well in excess of $100,000. He declined to comment specifics of the fraud allegations.

A first-degree felony conviction is punishable by up to life in prison.

After seeing the GOP VA Governor go down in a mind numbingly hilarious scandal where he and his wife "separated" as a legal tactic to try and convince people she was infatuated with the donor and kept taking gifts for that reason, not to peddle influence I cannot wait for this TX case to blow up.

http://www.washingtonpost.com/local...bbea_story.html

quote:

The jury’s verdict brings to a close a trial that seemed to grip the nation since it began in July with defense attorneys’ shocking revelation that the McDonnells’ marriage was shattered, and that would be a core element of their attempt to beat the charges.

The proceedings over the next five weeks resembled a soap opera at times, as the McDonnells endured a humiliating dissection of their relationship amid unflattering allegations about the lavish lifestyle supplied by Williams.

As the former first couple emerged from the courthouse, reporters swarmed, shouting questions. Robert McDonnell thanked the crush of media on the sidewalk for “the way you’ve handled this.”

Defense attorney Henry “Hank” Asbill, saying he “didn’t expect” this outcome, assured reporters that the former governor would appeal. “I’m obviously very disappointed,” he said.

William Burck, an attorney for Maureen McDonnell, said the former first lady, too, would appeal.

The McDonnells, who have been living apart since the trial began, left in separate cars. A few women could be heard shouting “We still love you!” at the former governor.

Shortly before that, top law enforcement officials declared that justice had been done.

As the governor’s time in office came to a close, he struggled in private with the growing criminal investigation, while publicly, more and more details of his relationship with Williams emerged. Among the embarrassing revelations: Williams had purchased a $6,500 Rolex for the governor, lent the governor his Ferrari for use on an expensive vacation and taken the first lady on a $20,000 New York shopping spree.

McDonnell finally apologized in July 2013, after The Post reported that Williams’s largesse had included $120,000 in low-interest loans to the first lady and to a small real estate company the governor and his sister owned.

They broke up their marriage in an attempt to beat a court case. Party of family values.

Nah, of the two DAs that could investigate one choose not to investigate and the other asked the Rangers to investigate because he had personal ties to Paxton.
