It'd first go through the Senate Judiciary Committee (and be blocked there), then to the Senate, where 60 votes would be needed to beat the filibuster (Dems have 46). If you know a guy who Obama likes who could get 14 Republican crossovers, well, you know more than any of the rest of us.

even beyond the threat of a fillibuster, Kagan was replacing Stevens- it's much easier to justify voting for a Democratic nominee on a good government basis when it isn't changing the balance of the court than when they're replacing a justice who was perceived as being committed to the Republican agenda

Pretty much the only situation I could see the GOP even considering an Obama nominee would be if it were a 75+ career capper that the GOP felt confident wouldn't make it through another term. Even then vacancy is preferable to them.
