That's not exactly what happened. AA Sales' argument was that Crumb himself failed to include a copyright notice on the work, a notice omission, and that thus made it public domain. The comic itself was copyrighted though, so they pointed to the fact the copyright symbol was not included on his publisher's business card. It got reversed in the ninth circuit, and as far as I can tell a notice omission these days only protects you from paying damages, for works before 1989. Nintendo's just protective of their stuff when money is involved, and probably doubly so when it goes against their family friendly image. They bought the rights to some dumb porno just to bury it.
