Noam Chomsky posted:explain why ironic Few things come to mind. 1) It's basically a mirror of Jim Crow juries in Southern states, where it didn't matter what the defense was able to prove the person was guilty for being black. 2) Similar tactic to what sovcits have urged before. 3) Juries decide matters of fact, not matters of law. 4) The moment you start mentioning the words "jury nullification" the judge is going to slam their gavel down halfway through it and throw not only you but potentially everyone else in the room out of the jury selection process. Primarily the irony I find is with #2. But I've been involved in enough court hearings that I'd see red if it happened to a client I was working with.

As the article points out, the Supreme Court ruled it legal in a decision but also said the judge is under no obligation to tell the jury about it. although a lot of what I know about it other than this article stems from an episode of How to Get Away with Murder, where a law student used a strategically placed brochure about jury nullification to engineer a mistrial.
