Anyone who cares about the Clinton email thing is an astroturfing idiot motherfucker. It's a scandal invented by Ben Ghazi and his Republican cronies, nothing more.

As a Bernie supporter and now Clinton supporter - as any actual thinking person should now be given what's on the loving line - I am ashamed of any Bernie folks buying into the email nonsense.

Honestly, we have an opportunity to get a liberal supreme court for a generation, during a time when we don't get the house back until 2042 or something, because of gerrymandering, and people care about emails? That's like a house burning down and some idiots arguing over if the floorboards face the right direction and if the kitchen cabinets are the right color rather than trying to put the fire out.

Reminder, the wingnut media machine stopped pushing Mr. Ben Ghazi so hard/dropped it and moved on to the emails when Clinton crushed her 11+ hour hearing. Bill's "got caught getting a BJ" hearing was only ~6 hours. IMO Clinton could go toe-to-toe with Putin in some weird KGB vs CIA torture duel.

This is interesting, but largely irrelevant. When you're talking about improper disclosures of classified information, compliance with departmental IT policies are the least of your problems. The question of whether on not she was OK to use her personal server as an unclass server for DoS business is a different consideration than the fact that she had TS/SCI/SAP on it. It's like worrying about whether your registration was current when you t-boned another car after blowing through a red light while DUI.

Also, at the idea that the CIO was supposed to intervene to stop her from doing anything foolish, even if she blew the CIO off. That sort of defense is available if you're an IT flunky at the embassy in Ulaanbaatar, not when you're the Secretary of State and the CIO's boss.

Finally, if the Secretary of State is getting notifications about politically sensitive drone strikes, they probably aren't coming from the military. Yes, no one out side the military has an acknowledged armed drone program, but come the gently caress on. An exigent circumstances exception doesn't apply. Even if it did, an exigent circumstances defense only applies to the person who lacks the means to transmit critical classified information securely. If a Navy SEAL calls the CAOC from a cell phone to get immediate air support, (as seen in the hit 2007 movie "Transformers",) it doesn't relieve the recipient, who presumably has access to secure means of communication, from safeguarding whatever classified information he passes on. It definitely isn't a defense available to the sitting Secretary of State.

Except that you're talking about classified labels on information that doesn't require protection, whereas Clinton had SAP information that required protection but wasn't labeled. Which is a much bigger problem. And yes, the Secretary of State should be able to recognize SAP level information even if it isn't labeled as such. I could understand maybe collateral secret or confidential information flying under the radar, but seeing information from a SAP would be like seeing hardcore pornography on broadcast television. Even if you don't know the relevant law, it would be immediately apparent that it didn't belong.

Stopped reading right here. Go ahead and cite where this happened. Bear in mind, that after the fact classification of information doesn't make the original transmission illegal retroactively illegal.

Also, I wish the media never discovered the term "SAP" because it's used all the time without understanding what it really means. While the granting of SCI eligibility also denotes TS eligibility, SAP and SCI elements are not necessarily TS. They are also not a "level" but rather a sub-set. They're simply a control measure within the body of individuals who may have a level of clearance. DR seems to understand some of this. I suspect DR is what we would call "someone who knows just enough to be dangerous" or commonly referred to around the office as "a loving idiot"

I said improper, not illegal. Even if, somehow, it turns out that nothing legally actionable occurred, there was still classified information being stored/transmitted improperly.

Also, if you're handling classified, I'd hope you'd understand that "retroactive classification" isn't a thing. If information is determined to be classified, it was always classified, just improperly labeled before. I'm just going to go out on a limb and say that, if another OCA looked at the information and determined that it needed protection, and was butting heads with State about it, it probably wasn't information that originated within the Secretary of State's office.

The word "classified" was chosen specifically because it referred to segregating information by labeling it as sensitive (i.e., classifying it.). The concept of information being "born secret" is unconstitutional nonsense.

That's not how the hierarchy in the government works. It's nothing like a CEO telling IT lacky #5 to just get him a new computer even though there's a waiting list.

She can exert that kind of control on her personal staff, but she can't fire the CIO anymore than she could fire a janitor who mops the the state department floors.

Even though the CIO is below the SoS as far as overall "prestige" they are parallel in effect. So yes, the CIO is responsible for ensuring that the systems under his/her purview are being used and maintained to FISMA standards.
