They've gone for years with their TOS, and suddenly, refunds and why they're not giving them becomes most of the focus of the new TOS. That, and the new verbiage that they're not required to complete the product, what they do make is not required to resemble what they said they'd make, and a failure state can only exist if they say it exists. Nothing at all weird about those additions. It's a totally typical TOS from a company who is fully confident in their ability to deliver.
