I would guess that's why they aren't even trying to build it anywhere near the western hemisphere; the laws in the pacific island chain they're targeting have got to be flimsy / non-existent. or the whole "under water" angle is massively over-hyped and it will be a normal theme park & resort on a tropical island with the addition of one or two rollercoasters that briefly dip under the surface of the water for a few feet of track.
