Pretty sure it's just that because Batman does not have a publicly acknowledged identity it means there's no copyright or trademark infringement meaning pretty much anyone can use his image for whatever.

I'm more interested in what the villains must think. Like, is Joker flattered/amused that a seasoning option is named after him, or are these restaurants basically just painting a giant target on themselves? Does Two-Face insist on a 50% cut of the profits off items based on him? Things like this.

I really don't think if Two-Face or Joker were real people that anyone would ever consider making a fast food item inspired by either. That's like serving John Wayne Gacy burgers and Jeffrey Dahmer "Drill Fries". I mean I'm fine with it in the concept of a silly comic book, but once you start asking about the legality of it, the illusion breaks apart.
