I mean in some cases the judge does need to ask questions because maybe the issues aren't clear or a remedy needs to be hashed out or the judge can use the oral arguments to brow best the lawyers into settling but ... yeah .. it's a relic of the English system and I guess makes appellate lawyers and appellate judges feel more connected to things. IMHO
