The long and short of it is that the Israeli Supreme Court (which is one of the most liberal and leftist courts in the entire world up till the past few years) wrote a pretty brilliant decision in 2006 concerning distinction in wartime. The core of the problem is that you have three categories of legitimate targets: privileged combatants (soldiers in uniform), unprivileged combatants (spies, mercenaries), and civilians taking a direct part in hostilities, and no one was really sure where to classify terrorists - International Humanitarian Law is unclear on the matter. Fortunately, the Israeli Supreme Court basically came up with a principle of renunciation, and it basically says that if you're an avowed member of a terrorist organization with whom we have an armed conflict, you're an unprivileged combatant and we can kill you. Generally speaking, the United States abides by this principle, though typically we are more choosy about our targets. In other words, Abu Hajaar isn't going to be the target of a drone strike, but we're quite happy to go after folks like Zarqawi or al-Shishani, as well as middle management in general. The ICRC, predictably, threw a shitfit about the decision and said that members of terrorist organizations are actually civilians and aren't legitimate targets unless they're literally firing a Kalashnikov on a literal battlefield. I seem to remember reading another article from the Daily Mail that was just loving ridiculous and made the SAS/SBS sound like a gang of supermen no-scoping people from 1000m and it just sounded like tosh. I'm sure the Government wouldn't think twice about killing a UK national under the right circumstances but I can't see them going out and deliberately hunting them. There were some serious legal challenges to the UK doing it in Afghanistan I think.
