Yep, that's true, and that just brings us to a whole other issue: 5th amendment protections. If a person has been pardoned for a crime, can his/her testimony be compelled (to convict/implicate others) since there would be no self-incrimination anymore?

There's a distinction between copyright violation and *plagiarism*, the two aren't the same. Plagiarism is about attribution, copyright violation is about permission. This is pretty clearly both.

If you're writing an academic paper, and you lift quotes from a source and put them in your work without attribution, that's plagiarism. But it's also plagiarism if you don't directly quote from the source but instead paraphrase it. Even if you rework the quote into your own words, you still need to footnote or cite the original source. Plagiarism is passing someone else's work off as your own, and that's definitely the case here. Plagiarism isn't a crime, it's an ethical violation, and plagiarism can occur even when copyright isn't violated.

Copyright doesn't just protect "the same," exact reproductions. This is what fanfiction runs aground on: if you write a new Star Wars story in the Star Wars universe, you are creating a derivative work and violating Disney's copyright even if you use not a single character from existing works. Your work is based on their copyrighted material, and you need their permission to do that. When Zeppelin settled out of court over "Dazed and Confused," it's because they were guilty of violating Jake Holmes's copyright, even though Zeppelin's version wasn't the same as Holmes's (Granted, it was bullshit that he waited until 2010 to bring suit, and don't even get me started on the Blurred Lines verdict).

It's not just similar poses. Also, there's another Del-Mace variant of this one that really clinches it for me, because the stool she's sitting on is basically a composite of the stools in both Del-Mace works. Hell, some of the knives are even in the exact same positions *and angles*.



This is every bit as flagrant as Buckley's "gamer girl," but something that's supposed to end up on the NYT bestseller list is going to get way more visibility than some lovely webcomic.

Correct! Specifically, it's been ruled that if you cannot be punished for your involvement in a crime because you've been granted immunity or a pardon (or were found innocent at trial), you must truthfully testify in any other criminal trials, on pain of obstruction of justice charges.

If I'm right, that's some pretty good schaden. Ol' Sheriff Joe must be counting on him not lasting long enough to face those charges if he's going this far just to skip out on six-months in jail or the like.

Nothing is going to happen to Arpaio. He was found guilty of contempt, he was pardoned for contempt, that is it. It is done. I'd have been happy for the corrupt bastard to die in prison, but the convolutions required to think he will face any criminal penalty at this point are beyond me.
