Anyone working with Christ Robberts must by definition be a man of great vision. Ortwin is clearly the top lawyer in all of Europe. That's why he failed to cover CIG in basically every way possible on this contract- that's a sign of advanced lawyering, breaching contracts on camera as part of your product's publicity drive.

He's definitely not a two-bit hack mostly used for drawing up boilerplate on porno videos.

FYI, when I looked into this a while back, it's considered bad form to act as a legal counsel for a company you helped found or are a partner to. Basically, it's because you are a part of any legal proceedings involving that company.

I'm no expert in this area, but could anyone else speak to this issue of acting as a lawyer for a company you are personally responsible for?

For instance:

If you are named in a suit, you can technically defend yourself, but only a fool does that. I co-founded a company and the first year served as General Counsel. Most of the work I did was writing policies, general contract review, and mostly filing patent and trademark related stuff (I was an IP attorney). Any major contracts went to our outside counsel at either Thompson Coburn or Bryan Cave. We never ended up in any litigation, but we had Bryan Cave on retainer in case that ever did happen as well as handling our international contracts. About two years in I took over at CEO and went to inactive status on my bar license. I was not a practicing attorney at that point and all our legal stuff was handled by Thompson Coburn before I sold the company.

It doesn't matter. According to CryTek, CryTek owns any single improvement, code change or feature CIG added to the engine since 2012. That means CryTek owns Star Citizen and SQ42, and, in their lawsuit, are not only asking for damages but the entire game to stop production, permanently.

If any asset has a single trace of CryEngine or CryTek technology, or was built or modified using those technologies, those go as well. CIG would be looking at starting from complete scratch, Lumberyard or no.

Everybody always said it’d be better in UE4. Though today we know there’s no engine they’d of chosen that could have helped them. It’s not CryTeks fault, it’s all Chris Roberts and his being a chump with a chip on his shoulder.

This might be a weird comparison to make but maybe some EVE players will get it.

These guys sound exactly like the pubbie alliances we started kicking the poo poo out of. Whenever they knew their situation was hopeless our spies would start capturing endless examples of exactly this kind of thing where they start theorycrafting and dreaming of how they will be rescued by someone bigger and stronger.

Only when they couldn't deny it anymore did they always shift into the "Well losing was a good thing because we have become untethered from our space and can now become lean elite wolf packs roaming the spaceways. You actually did us a favor silly goons."

This time it is CIG who are at the wrong end of a 'death by litigation' battle. They are used to being the side with attorneys that have nothing better to do than create work for a consumer (who typically doesn't have a large legal budget).

CIG will likely have to retain someone like Venable if they seriously want to prevail. And they are not cheap either, so it boils down to who has the resources for the long-haul. Skadden had the luxury of reviewing the case and its potential before taking it on and pushing it to this point. CIG is behind the eight-ball here.

The only thing they might have in their back pocket is one of the things Ortwin mentioned in his article, insurance to help defray these type of legal expenses.
