https://www.nytimes.com/2017/12/20/us/president-trump-iowa-commutation.html

quote:

President Trump on Wednesday commuted the prison sentence of Sholom Rubashkin, whose Iowa meatpacking plant was the target of a huge immigration raid in 2008, and whose 27-year prison sentence angered many Orthodox Jews.

Mr. Rubashkin made national headlines nine years ago after federal agents arrived by helicopter at the Agriprocessors plant in Postville, Iowa, and detained nearly 400 undocumented immigrants, :siren:including several children, who were working there.:siren: Mr. Rubashkin was the company’s chief executive, and the plant had been the largest kosher meatpacking operation in the country. He was later convicted of bank fraud in federal court.

Many Jewish leaders have rallied behind Mr. Rubashkin, whose treatment they said was unfair, perhaps even anti-Semitic, and whose sentence they considered unduly harsh and out of line with what other white-collar criminals received. Mr. Rubashkin had tried for years to get a reduced sentence, but was repeatedly turned down by the courts.

“Rubashkin has remained strong throughout his ordeal and convinced he would eventually obtain justice,” said Guy R. Cook, the lead trial lawyer for Mr. Rubashkin, in an email on Wednesday night. “Rubashkin and his family are overjoyed he is free and will be reunited with them.”

In a statement announcing the commutation, White House officials said they had received letters from more than 30 members of Congress, including several members of both parties, supporting an examination of the case.

“The president’s review of Mr. Rubashkin’s case and commutation decision were based on expressions of support from members of Congress and a broad cross-section of the legal community,” the White House statement said.

Senator Orrin Hatch, Republican of Utah, said on Twitter that the commutation was “a real Hanukkah miracle” and that he was “proud to be a part of a large, bipartisan group” that had pushed for that outcome.

Mr. Trump’s decision was not a pardon, and Mr. Rubashkin, who had been imprisoned in Otisville, N.Y., must still pay restitution and complete a term of supervised release. The commutation came after years of lobbying by a number of prominent lawyers and politicians who considered the sentence a miscarriage of justice.

Alan M. Dershowitz, an emeritus law professor at Harvard and a noted author, said he had been working on the case for about five years and had personally asked Mr. Trump to consider commutation. Mr. Dershowitz said he had made a similar request to Barack Obama during his presidency, but that he had declined.

“It was just compassion and justice,” Mr. Dershowitz said. “This was a bipartisan thing. It was a nonpartisan thing. And it was the right thing to do.”

But the commutation was not universally cheered. Robert Teig, a former federal prosecutor in Iowa, said that Mr. Rubashkin’s sentence “was what he earned because of his conduct” and that “it’s a sad state when politics are allowed to interfere with the justice system.”

“Really, this is 180 degrees contrary to a tough position on illegal immigration,” said Mr. Teig, who said Mr. Rubashkin had probably been Iowa’s largest employer of undocumented immigrants.

The high-profile immigration raid eventually led to the closure of the meatpacking plant in tiny Postville, which had become an unlikely hub of Orthodox Jewish life in the Midwest.

Around 300 employees of the plant, many of whom were Guatemalan, served prison sentences for identity theft, and several managers and supervisors were convicted of felony charges of harboring illegal immigrants. The immigration-related charges against Mr. Rubashkin were dropped after he was convicted of fraud. Prosecutors in his case said he had fabricated collateral for loans, causing the banks to lose more than $26 million.

What kind of stuff went wrong? Did anybody die or poo poo their pants?

A well executed choke applies pressure to the arteries and veins leading to the brain to cause a temporary state of hypoxia that feels like sleep but does this without restricting the airway. If applied properly, a choke will start to work in a few seconds. I've been choked out before while sparring in judo, and from what I remember the world went gray and I went to sleep. The sorts of things that can go wrong are constriction (or crushing) of the airway, dislocation of the recipient's jaw and even broken necks. Even correctly applied chokes can still cause damage-- hypoxia will induce unconsciousness, but if it continues it can also cause a person's bowels and bladder to empty themselves. Continuing beyond this point can cause seizures. The idea is when your target goes limp, let go.The guys I worked with that were known to do this were good at it so I never personally saw someone get hurt from a choke but there have been plenty of incidents all over the world where someone winds up getting strangled or their neck broken by some meathead who doesn't know what they are doing. Where I worked, bouncers had to be able to articulate why they used the level of force that they did when removing a patron, beyond "he pissed me off so I hosed him up." The local police strongly discouraged chokes for the reasons described above, and later outright told bar staff to never use them. Personally, I preferred to talk people out. Firm and fair goes a long way and doesn't piss off a crowd so much as the sight of a massive bouncer latching on to someone and hauling them into the night does. If I had to get physical, I simply used arm or wrist locks in a reward based system. Do as you're told, and the pain's minimal. Get nasty, and the pain turns to agony.

That said, I remember one incident wherein one of my coworkers choked out a patron who had a long history of physical violence. This individual was the lead bully in a pack of assholes and one night one of my colleagues decided to make an example of him in front of his underlings after he slapped one of our bartenders. This sort of behaviour usually prompts the bouncers to swarm the individual in question and drag him or her bodily out of the bar and possibly into the waiting hands of the police, but in this case my colleague got there first and clamped on a textbook hadaka jime and waited. At about four seconds, the bully stopped thrashing and went limp. About two or three seconds later, he was handed off to his deeply frightened friends with a growing wet spot on his jeans. A busser quickly mopped up the puddle of urine on the floor before it got tracked all over the place.

That is the revolting truth that makes everything lovely about America so hard to fix, and most of our own dumb excuse for "the left" can't come to grips with it. Our right of course runs on it, Trump just made it more obvious than it already was.

The backlash against the civil rights movement and the backlash against expanding welfare programs being simultaneous was not a coincidence.

The poor should go to religious schools, graciously provided by right-wing churches, which pump out little Republican voters by teaching that Democrats are evil.

I’ve seen a worrying amount of posts online from other parents about how they are forced to send their kids to cheap subsidized religious private schools because the local public schools are complete poo poo due to underfunding. They are worried about the level of indoctrination their kids are getting, but feel that they have no other option. DeVos and her ilk are setting up this conundrum to require parents to either send their kids to underfunded secular shitholes or pleasant, happy indoctrination camps, quite deliberately.

And I’m pretty sure it’s ALSO a de facto way of introducing segregated schools, because statistically a lot of black families are so poor they probably can’t even afford the low fees for private religious schools.

I think everyone in congress is super loving nervous about the reveal of that investigation. The Republicans know they aren't going to do poo poo regardless of what he says but don't want to be seen as being complicit to an administration that is not only treasonous but also subverted democracy with a foreign power to get elected which is why they are heavily getting their media allies to start muddying the water. The Democrats on the other hand want to take down Trump, but I'm guessing they are much less willing to handle the Constitutional crisis that will occur when the Republican party decides that the President is above the law and electoral fraud is fine if you win and actually having to go to war with them if they want to maintain any credibility as a party.

Honestly it would probably be better for both parties if Congress just threw Trump under the bridge and the Republicans got the Democrats to help rebuild their image (which the Democrats would probably be happy to do in exchange for Trump's head) but there's no way the GOP has the guts to stand up to their king.
