There is an element of literalism and historical factors that do not come into play in "normal" communication. Usually contracts are verbose and extremely explicit to avoid any issues of interpretation. Without going into a discussion of how "exclusive" is defined in english, because I am not a native speaker, I do think it's obvious that the sentences are poorly written and ambiguous to at least some extent.
