Leonard actually seems pretty smart. All of the sudden he has been thrust into a situation where he has an interested audience whose most well defined characteristic is their ability and desire to throw money into hopes and dreams. He makes the appropriate distinctions that what he says are his interpretations only, and he is not a specialist in the field. Then he feeds them hopes and dreams. He is just taking advantage of a good deal.

The preliminary injunction will certainly be denied. There's no irreparable harm that cannot be remedied by a liquidated judgment (i.e., cash money) at the end if Crytek prevails.

The injunction may or may not be granted at the end of the trial if Crytek wins, to which Crytek is entitled to if there's a copyright violation. If it is, then it takes effect at a time the court deems appropriate, which may be immediately once the judgment is entered. This can be stayed pending any appeals, so if and when the poo poo truly hits the fan there will be long notice of it happening. How it'll be enforced is going to be crafted by the court with the plaintiffs strongly advising -- Crytek can basically write the order for what they'd like to see to ensure satisfactory behavior, and the judge can sign off on it or modify it. Remember, at this point CIG has had an open and fair opportunity to show no wrongdoing and if the injunction takes place well they've hosed up in the eyes of the court and under copyright laws they're not entitled to any real benefit of the doubt. This can be pretty drat invasive, and as we've seen before in other cases the fact it's fatal to them is of no import to the court; after all, the law itself wants the consequences to be heavy and painful.

I wouldn't be surprised if CIG is forced to allow Crytek to audit the whole thing top to bottom and Crytek is allowed to go "this is mine, this is mine, this is mine, this garbage is not ours, eww, this is mine..." until there's naught left but T-posed commandos and jpegs.

Also discovery and stuff like getting all the hearings in place before setting a trial date should start kicking into gear once the initial handshakes finish. If CIG stalls, then the court can get real cross, especially if the other side is ready. The court will be content with delaying things if there's serious settlement talks going on though; getting out of actually holding a trial is job one in the court system given how many cases are pending on a typical docket. Both sides seem dug in and are lobbing grenades o'er the top, but that could be just a front while serious talks by adults are being held in a conference room somewhere, it's happened far too often to dismiss. CIG probably has no adults in charge though.
Couldn't a judge keep kicking the can on a trial date in hopes that a settlement would be reached or is Space Court date set in set in stone. Is it me, or is the lawsuit the first time CIG are achieving their deadlines?

The theorycrafters are right. It is lazy.

What happens if your car gets stolen, lost or destroyed repeatedly in real life? Your premiums and deductibles go way up. Some people pay so much it's like buying multiple new cars per year.

If your ship is lost often in the game, your deductible should keep going up until it's nearly the full price of the ship. Conversely, a thief can only sell the ship for 25% of it's value. Insurance fraud would not be profitable, long term, but theft would still be somewhat lucrative. Solved.

The warlords will be totally cool with paying huge deductibles on their ganked Javelins.

A judge has discretion over her own calendar but both sides have to say "we're almost there can we have a little more time?" Time runs in favor of the defendant in a case like this, so being dilatory without any reason except a faint hope that one side or another will break is prejudicial.

One thing to note too is that this is a jury trial. Once that's set and jury selection begins things move. You do not gently caress around with waits and hemming and hawing, especially if one side wants this shitshow to begin. That's when the judge gets to bang her gavel and levy sanctions for wasting time. But we're a ways away from that. And all this back-n-forth is built into the typical timeline for a court case. So you'll have discovery, you'll have motions in limine, arguments over who gets to show up as an expert witness, the all but guaranteed pit fight when both sides submit motions for summary judgment, etc. There's a ton of stuff that isn't designed to make a case tarry, but it does anyway.

The whole absurdity of this project (and of course more recent events) never ceases to amaze me.

I like how reddit is coming up with ways to keep the stolen ship "alive" by having members of your org never signing off. Like passing the torch.

The problem is from a simple standpoint, how does the server know who "possesses" the ship in the first place? You and 10 (haha) others board and fight your way in while you rape and pillage. Does it know that the ten of you in the physics grid are the owners now?

They try to solve one problem which pisses backers off and it creates ten more what-ifs. It's just a loving laugh riot with their total lack of understanding of basic game mechanics and what can happen when you have an idiot at the helm waving his hands.

They haven’t gotten this far, and may never. There will be so many mechanics that we will never see how they implement it will be cute.

I wouldn’t be surprised if it vanishes when whoever requisitioned it from the terminal logs out, or just whenever the server has to be reset every hour or something. We’ll probably never know. :eng99:
