ADSL congestion is different to cable because it's an individual connection instead of a shared line but yes it's possible your brother is poo poo out of luck if there's no other provider yet. But you're telling other people the TIO is a waste of time for reasons specific to your brother's case. Synth has NBN. Edit: as in, NBN usually means more providers get into the area. Aside from a mixup during the relocation of our service when we moved last year, it's been pretty solid (apart from their routing tables getting hosed for 20 minutes the other day).

I know nbn has been painful but you soon won't have any choice because they're going to start cutting off landline and ADSL from August this year.
