why can't you just shoot somebody in the face without consequence? if you didn't contract with someone to agree upon a neutral mediator / police force, it seems like the only way in which someone could arrest and try you would be if people had some sort of blanket right to catch and punish people who violate the nap. but that looks an awful lot like a general law that can be used on nonconsenting persons. and what about negligence or recklessness? does it violate the nap if you shot a gun without looking in front of you and accidentally hit someone? or what about pure negligence that causes a death - you back up without looking and you hit a kid with whom you have not entered into a contract. If that is actionable and tryable as a violation of the nap, where does the enforceable duty of care which we expect drivers to exercise come from? Again, looks a lot like a generally applicable law. So if those are not prosecutable, it seems like you would have a problem with people shooting other people in the face. If they are prosecutable, it seems like your bootstrapping in a tort and criminal legal system so who comes up with those tort and criminal laws? a slow development of community standards applied across different cases? congratulations - you've invented crowdsourced common law without a centralised court system to give it coherency or predictability. or maybe the adjudicative agencies contract with one another to follow certain principles.
