To be honest, I hate charging things as hate crimes. It adds an extra element I have to prove beyond reasonable doubt and one more thing some jackass who slips by voir dire by giving the “right” answers can hang the jury on. And it ruins my great instruction about how I don’t need to prove motive. I’d rather put all that evidence in and argue it as aggravating factors at sentencing.

What exactly are you advocating for? A federal law that says, "it shall be a crime to say ____________?" Or "It shall be a crime to assemble, with 2 or more persons for the purposes of ____________"? I mean, pick anything that doesn't punish "thought" as a crime and ask if it accomplishes a goal that current criminal law doesn't already prohibit.

I think the point is well made that people fought back against McCarthyism because it was such a cancer to democracy, and it was very much a tool for controlling political narrative and squelching dissent, much like the way "Yeah, but Nazis!" is/has the potential to be. See, Sullah's Proscription

I'm gonna pass on writing an entire manifesto since this conversation is dragging down the thread. But I'm completely fine with what Germany does. They have both specific anti-Nazi laws and also a broader set of rules that essentially makes it illegal to incite hatred, to provoke violence, or to insult, ridicule or defame "parts of the population" in a manner apt to breach the peace.

Basically, in the same way that we don't allow people to shout "fire!" in a crowded theatre, they don't allow people to shout "the X race are cockroaches!" at a demonstration.
