one thing marcy was speculating about (and, again, we have no reason to think this yet) is that it's not about testifying in front of the grand jury - others have challenged that and those challenges are all public - but rather some issue where Mueller's team is trying to pierce attorney/client privilege. that would be a LOT more sensitive, if they're trying to claim they have proof of the crime/fraud exception, even the assertion that it applies could be extremely damaging
