Technically it isn’t circumventing the laws of the game because it’s the easiest way for the defender to play that ball and he didn’t deliberately lift the ball to his head using keepy uppies or whatever.

While they do need to amend the back-pass wording to explicitly account for this sort of scenario, the "unsporting conduct" rules are clear and broad enough that a referee can and should card the players here. In any case I imagine it's the kind of thing you'll see only in friendlies because just a minor slip-up would lead to an own goal.

Cautions for unsporting behaviour There are different circumstances when a player must be cautioned for unsporting behaviour including if a player: - uses a deliberate trick to pass the ball (including from a free kick) to the goalkeeper with the head, chest, knee etc. to circumvent the Law, whether or not the goalkeeper touches the ball with the hands

The referee must recognize the difference between situations during dynamic play, when opponents are constantly exerting pressure, and events developing from static situations, such as free-kicks, when the opposing team must be at least ten yards from the ball. The referee must always consider the distance between members of opposing teams as well as members of the same team before making the call.
