I don't think there is any possible reading where "that sounds like it might deter someone" would imply disapproval, from a legal perspective. The whole point of it is to deter people.

Sorry if I was unclear, I don't see this as a Vic win, its more like the judge is saying "I'm already charging him 500k+ I think that is sufficient deterrence and you want me to add onto that?" Basically I see it as they are getting their full legal fees but not additional punitive sanctions. There is some back and forth later when Lemoine brings up the GFM like Chupp is considering it though so who knows really. Its hard to call it one way or another, basically the judge isnt letting them gather new evidence to support the misconduct at this stage, but hes said in the thing that if it becomes relevant he may change his mind, but he feels they have a better chance by bringing up the gfm

The Judge also kind of subtly implied that 'The Hellfiling' (Plantif's response to the TCPA) should be substantial enough in proving sanctions, though you could read that in favor of — or against — additional sanctions on top of all the nonsense involved with that.

There's a couple of things going on: The main case is Vic vs. Funi et all it is currently at all charges are dismissed under the TCPA act and awaiting the final ruling on the Fees and Sanctions as to what Vic owes. The Defendant's lawyers have submitted their bills and its just waiting on the hearing scheduled on Thursday the 21st (likely to be pushed back by the continuance Vic's team asked for) the Vic side will probably submit written responses to the Fee motions(although they don't have to). This part can't really get any worse for Vic although Lemoine(one of the defense lawyers) is trying to depose Slatosch so he can get on record 1)Beard knew the case was frivolous to begin with (the tortious interference didn't happen/the def's tweets didn't cause him to cancel the contract with Vic and Beard knew this the whole time.) 2)Beard/Slatosch possibly committed perjury a couple different times. This would be disastrous for the appeal/possibly result in more sanctions. The other thing going on is the appeal of the TCPA dismissals where Beard and co are going to argue the judge hosed up give us a do-over/reduce our fees and sanctions please, which is probably not going to go anywhere(because the record Beard established is total garbage) and will cost Vic more money paying Beard and the defendant's lawyers wasting everyone's time, there is an outside chance that they might decide to reduce what Vic owes for whatever reason. The worst possible outcome is actually probably the appeals court overturns 1-2 of the counts and returns them to the lower court where they die to summary judgement wasting the maximum amount of money and time. The expected outcome is everything upheld go away. (Beard kind of hosed this up by filing early but it didn't really hurt anything and likely they are just going to drop it/have it get dropped by the appeal court and redo it after Chupp rules on what Vic owes burning about 6 grand in fees completely due to incompetence) TL/DR: Lawyers get paid everybody else loses thanks legal system(the defendants get screwed slightly less because Vic is gonna pay their bill but they still lost work and got harassed.)Vic of course deserves it but only got it because of dumbness. My mom works in the Tarrant County courthouse as a proofreader for the criminal court. Since this is civil she doesn't know much about what's going on but she knows a few people (has worked with Chupp a few times). She told me she'd be willing to ask around if I have questions but she needs more details. I've got the case name, the district court clerk (who she would know), the counsel, and the judge's name. That'll be enough but I am mostly interested in hearing how people are reacting to Ty Beard. Unfortunately I don't have a good summary of just how bad Ty Beard is though. I think she would need that to know who to ask. The twitter threads would be too much for her to figure out. Is there a similar summary of his terribleness which isn't on twitter?

The general rule is that you should expect that the prep time for a proceeding is at least twice as the actual time spent in the proceeding- such as a deposition/trial whatever. This poo poo's not like TV were people just show up to trial and do it off the cuff or whatever. Pretty dumb comment

For my last deposition, I prepped with two attorneys for ~20 hours, so 60 billed to the client in total. The depo itself took 3.
