America has an incredibly stupid court system. Gawker's destruction is infamous for Peter Thiel backing the lawsuit because he's a huge pissbaby that was upset Valleywag outed him but the only reason they were able to destroy Gawker was because of a dumb quirk of the law since the suit was originally against radio shock jock Bubba the Love Sponge who ended up settling.

Between two parties of roughly equal means, sure, but the whole problem of SLAPP suits is that guys like Bob will happily piss away a few million dollars if it means they can keep a story out of the press for a year or longer. The cost is immaterial to them. It does at least mean that their target is not destroyed by the lawsuit even when they win, but they still have to find a way to eat those costs as the lawsuit is ongoing which might end up ruining them before they get an opportunity to get that money back.

Yeah Thompson was disbarred although bear in mind that being "disbarred" is not actually a consequence employed by the courts but rather something that the bar association will do if a lawyer professionally disgraces themselves in some way. It does prevent him from practicing law but it was a professional organization that did it to him rather than the legal system.

Isn't the whole deal that wealthy businessmen have lawyers on retainer so it doesn't actually cost them much extra to send them out to kill whereas human beings have to go searching for a lawyer and then can get crippled by the costs involved.

There's no "dumb quirk." Hulk Hogan's sex tape wasn't newsworthy, and Gawker got its poo poo rightfully pushed in for publishing it (and being dipshits in court).

Are you really arguing the investigative bona fides of a gossip rag?

Generally it’s tied to a Summary Dismissal with Prejudice. Essentially a judge looks over the briefs before the trial even starts and says “This case is bullshit, you’re an rear end and stop bothering these people.” This completely ends proceedings on the case unless the dismissal is successfully appealed and then everything starts over.

A judge’s ability to decide is usually the reason lawmakers are hesitant to expand anti-slap suits, a lot people believe of something is already covered by a law there’s no reason to make more laws.

Yeah Gawker was completely in the wrong and had multiple chances to make things right. It's a shame since while I hated Gawker itself the sites under it's umbrella did a lot of great writing and investigative journalism. Since the sale they are all failing badly due to incompetence from ownership.

Exploration is ill-advised.
The whole Gawker thing seemed extremely avoidable given they literally contravened judge's orders to take the tape down, and admitted in court they would publish child porn if they deemed it newsworthy. It was own goal after own goal.

Ok so now I have to check my drawer in work tomorrow, as I already did the census after getting mail (physical, multiple) and I could’ve sworn it contained a question about my citizenship (which I don’t have, I’m a Permanent Legal Resident). So hearing it’s happening *next year* is a slight concern.

Dug out my paperwork, and it was legit (.gov addresses etc, which is why I didn't really question it when I did it). So I guess they're starting early? And there definitely is a question about citizenship -

quote:

8 Is this person a citizen of the United States?
[ ] Yes, born in the United States ➔ SKIP to question 10a
[ ] Yes, born in Puerto Rico, Guam, the U.S. Virgin Islands, or Northern Marianas
[ ] Yes, born abroad of U.S. citizen parent or parents
[ ] Yes, U.S. citizen by naturalization – Print year of naturalization
[ ] No, not a U.S. citizen

I was pretty run down when watching last night's show, but I could've sworn John said they weren't going to include this afterall? Full question list is at https://www2.census.gov/programs-surveys/acs/methodology/questionnaires/2019/quest19.pdf . Ironically, they don't ask how many bathrooms I have but one of the questions asks how many rooms in my house specifically not bathrooms.

It just never gets old how the core conceit of our democracy is under constant assault, but it does get exhausting.

Sabotaging the census is a pretty complex tactic, the defense against the impeachment is childish and absurd. When they say it's just Trump being Trump, well...extortion and flaunting all legality and due process is the bulk of his career, so when they're right, they're right.

Remind me some day to make a database out of all the stuff Adam & Eve has sent me over the last few years.

Many years ago, if you and your good lady wife were looking for some marital aides (and I love the term "marital aides!"), you might go to a website like Adam & Eve, which had supplied you with the implements of naughtiness for years through their mail order catalogues. Sure, it was basically a weird website that was an electronic version of the paper catalog, and sure, you had to call them to give them your credit card info, but it was so much more convenient! Somehow! And in the near future, it was going to be much less frightening to enter your credit card info into their newfangled "pay online" option....

I can't remember the last time I even went to their website. It was after I got gmail, but that was a long time ago. But starting about five years ago or so, I began to get the dreaded "IF YOU DON'T ORDER SOMETHING, WE'LL HAVE TO CANCEL YOUR ACCOUNT, BECAUSE IT COSTS MONEY TO KEEP IT OPEN!!" messages. Now, mail order businesses used to do this, and they were serious: you would lose your account, and you'd get no more catalogs. Why? Because it cost lots of money to send them. But it costs almost nothing to send emails en masse, so I ignored the messages. And I still get them at least once a week. I also get daily--daily--emails from them, offering me increasingly amazing deals on oils and other goo, movies focused on fetishes I have no interest in, and various tubular things filled with rubber pussy.

I'm not even offended or annoyed anymore. It's like a daily joke.

I feel like a bit of an outside case, because I actually quite like unimportant (at least in the general sense) push notifications. I have them left on for my podcast app for instance, since it informs me when there's new episodes out for stuff I actively listen to each week. That's important to me though, so there is that distinction. On the other other hand, I have them enabled in YouTube as well and get a dozen or more push notifications throughout the day. I barely pay attention to them, and don't check my phone obsessively for them or anything; I just like that there'll be something I'm interested in popping up as worth while checking out if I have a few minutes here or there. Then again, I also have essentially never curated my general email account and there are over 10,000+ unread emails there. Which doesn't bother my rear end none, because anything important is going to be near the top anyway, I can favorite/star anything actually important and search exists if I want to find something older than a few weeks.
