The optical effect is real and can be recorded on camera, but your brain's interpretation that the ship is above the water is in error. The article's description is not very good though, it makes it sound like the kind of optical illusion where like the dots on the page appear to vanish or something .

Yeah I was wondering that. Like why is the horizon not behind or above the ship? No amount of light bending would put it below the ship. Unless that's not the horizon, which is plausible, but it looks too sharp a contrast with the sky not to be

The light from the ship isn't bending that much, we are talking about nanometer levels here.
The denser/lighter air bends the blue part of the light from the ship and surrounding water changing it so that it has the same color as the sky that meets the water from your position.
Blue light has a wavelength of 450 nanometers, the air is 'bending' it by a few namometers just.
The light from the ship is bending too by this amount.

The image tricks the brain. Easiest way to think of it is there's a mirror on the ocean that's reflecting the sky - your brain therefore sees sky "under" the ship and is convinced it's flying and disregards all other cues telling it otherwise. Cover the ship up and the "seam" between the sky and the reflection is much more obvious, cover up the reflection under the ship and the fact that you're missing the bits of the ship beneath the waterline becomes obvious.

I think that their entire explanation is in fact wrong because like I say you can see - particularly at the right edge of the photo - the "seam", which suggests that it's actually just a conventional mirage over the ocean reflecting the sky. The only way to be sure would be with a theodolite or something I suppose to work out where the actual horizon is.

The water is outside of the air forming a 'duct' from the position of the observer to the boat (in reality huge flattish sheets, but your brain/camera only cares about lines between the object and your eyes/sensor), you can just about make out a faint false horizon around the level of the base of the boat, but you can't see outside of the duct because of how it's bending the light.

It's not dissimilar to the effects that make the sun a thin slither a few arc minutes above the horizon if you have exactly the right sunset, although in that case it's bending light that you wouldn't ordinarily see (because the sun is below the horizon) into your eyes/camera.

While that's definitely the case I'm even more gobsmacked how useless the EHRC is after the whole Pontins thing.

Always thought doing discrimination like that would come with some financial penalties at least.

If anything I can see a lot more companies (particularly estate agents and the like) taking it up after seeing what the consequences are, i.e. basically none.

I get the impression that this is just a one off ruling and not a statute, but it'd be nice if some kind of press standards body decided to use the ruling to justify why this should always be the case.
