RGB is terrible but this would have happened no matter what she did, just as a 5-4 decision instead. Kennedy retired knowing he'd make way for someone like Kavanaugh. Kav was his own loving clerk.

Basically every conservative advocacy group and multiple heads of state level government, in addition to sitting members of Congress, have all been pushing a unified narrative that everything LGBT+ is just a smokescreen for people to molest and brainwash children. Like the guy who successfully poisoned CRT as a talking point and used it to overrun schoolboards across the country has said as much straight up, just like he had before. To claim this is still debatable is to ignore stuff so obvious that even the politically disconnected are getting bombarded with it.

She might, but doesn't really need to. McConnell's (flimsy/bullshit) justification for delaying was the election. With the election over, he'd have been forced to consider and confirm Garland. Ditto Kennedy and RBG might have retired right after Clinton's election so that's three safe seats. Possibly four if Breyer had moved up his own retirement to take advantage of Clinton being in office.

RBG being replaced in 2014 would have made this a compromise 5-4 decision with Robert’s deciding which of the two sides he could cut a deal with to weaken but not overtly overrule the existing precedent

Possibly. In the immediate future this is a huge setback for women's rights, but in a way, we now know where the real fight has to be. In the state legislatures and governorship. Oh and state legislatures are generally where your future House Reps and Senators come from. Governors are generally where your Presidents come from. The GOP waged a 50 year campaign to get to this point. Liberals/Dems are going to have to muster similar determination to fight back.

It's not a favorable citation. He says that the Scott case was flawed due to its reliance on something like substantive due process. (This follows Bork, who in some book said that Scott and Roe were the two worst decisions of their centuries.) His views are repugnant enough as they are.

McConnell didn't hold the seat open by successfully persuading anyone based on the strength of his excuse, he did it using his power as Majority Leader to set the Senate calendar. As such, he can only hold a seat open while he's Majority Leader. If Hillary wins, then in order to steal the seat, the GOP has to hold control of the Senate in not only 2016 but also 2018, and then defeat Hillary in 2020. If Hillary wins again in 2020, then they have to hold onto the Senate in both 2020 and 2022 as well. And so on.

Even if you assume that holding the seats open indefinitely doesn't provoke a political backlash against the GOP, they're still gonna lose eventually.

Refusing to allow Supreme Court appointments for several years straight would presumably damage the legitimacy of the Supreme Court

It definitely was unfavorable, he cited the Chief Justice in Dred freaking the gently caress out about how black people being citizens would mean they could bear arms, which would of course be terrible, to support his claims about what the Second Amendment has always meant. It's not a great look for a lot of reasons, but it's a cite of "look, even this terrible rear end in a top hat agrees with me."
