A recent photo used for the Balenciaga website included a document featuring United States v. Williams, which was "a decision by the Supreme Court of the United States that a federal statute prohibiting the 'pandering' of child pornography (offering or requesting to transfer, sell, deliver, or trade the items) did not violate the First Amendment to the United States Constitution."

This coincides with a photoshoot for Balenciaga Objects in which children are pictured holding BDSM-themed teddy bears.

NY Post posted:

The photographer who shot the controversial Balenciaga ad featuring BDSM teddy bears modeled by children has broken his silence.

Gabriele Galimberti issued a statement on Instagram Wednesday morning after the inappropriate ad was pulled by the fashion house.

“Following the hundreds of hate mails and messages I received as a result of the photos I took for the Balenciaga campaign, I feel compelled to make this statement,” Galimberti wrote.

“I am not in a position to comment [on] Balenciaga’s choices, but I must stress that I was not entitled in whatsoever manner to neither choose the products, nor the models, nor the combination of the same,” he continued.

He explained that he was permitted only to light the prepared scene and shoot in his “signature style,” but noted that the “direction of the campaign and the choice of the objects displayed” were not in his control.
...

Balenciaga has since pulled the controversial ads and apologized for the disturbing photos.

A spokesperson for the luxury fashion brand told The Post, “We sincerely apologize for any offense our holiday campaign may have caused. Our plush bear bags should not have been featured with children in this campaign. We have immediately removed the campaign from all platforms.”

The company added in an Instagram Story, posted before Galimberti’s statement: “We apologize for displaying unsettling documents in our campaign. We take this matter very seriously and are taking legal action against the parties responsible for creating the set and including unapproved items for our spring ’23 campaign photoshoot. We strongly condemn abuse of children in any form. We stand for children safety and well-being.”

Seems the answer to that may be Because they were given the models, outfits, and staging without those documents and were not given the creative control to show their disgust in any other way — knowing that if they didn’t, someone else would make the campaign without the self-reflective lens. They may also have needed the money by this point with these specific restrictions being imposed late into a process where that was to be a major paycheck for them in that period of time. Between this and Kanye’s White Lives Matter shirts, Balenciaga deserves no benefit of a doubt. The individual worker I am willing to extend that grace to, especially when this all seems to be implicit in their recent statement.

A Supreme Court case? I can think of a shitload of reasons why someone would print out a Supreme Court decision.

It's definitely a weird pic for an ad campaign, but it was an ad campaign for Adidas shoes.

The ad with the printout in it was not one of the ads for the BDSM bears with the kids. It was for a different campaign altogether and there were no kids or sex toys in it.

This comes up a lot. Iggy Pop's "Lust for Life" for a cruise line, "Jane Says" in a booze ad, Apple used the Pixies's "Gigantic," the list is endless. Most people don't listen to lyrics.

I swear I heard a commercial using “We Will Become Silhouettes” by The Postal Service, either for a car or candy. May have been M&Ms and “Such Great Heights” though. The latter song is about love, but the former is clearly talking about dying in a nuclear strike.

16 tons is about being a coal miner trapped in a never-ending spiral of debt and physical breakdown. Semi Charmed Life is about being a meth addict. Melt with you is about dying in a nuclear holocaust. 99 red balloons is about dying in a nuclear holocaust. Lust for life is about being a heroin addict / Iggy Pop.

Pogues were a punk band, presumable not the kind of people who would endorse sedan-driving middle-class-ism.

It's about being damned for your sins and accepting that you won't go to heaven when you die. From the context of the band it's probably sung from the perspective of an Irishman who killed British soldiers during the Troubles.

The lyrics are pretty explicitly about death and watching someone die. Maybe Polaroid were trying to get into the memento mori market, lol.

I saw a really effective Australian (I think) PSA about drunk-driving that used Pictures of You. It was just relatives of folk who'd been killed by drunk drivers sitting with photos of their lost relatives.

The other one that gets me is “You Are My Sunshine” - I cannot understand how anyone would think the lyrics are positive unless they’ve never heard (or thought about) anything beyond the first half of the first verse.

That's one of those songs where people pick and choose the lyrics to use. I've heard it all my life--it's been sung to three generations of babies in my family, not to mention all the popular culture appearances--and it's only ever the chorus, which is clearly only positive.
