you can argue all kinds of things, maybe even successfully, but to get to that point you need to spend a year or two and five or six figgies fighting the lawsuit (which is the real point of noncompetes/NDAs/nondisparagement clauses)

In almost no scenario can you freely share previous employer private info/trade secrets. There are lots of regulations, laws, and civil actions against it. Getting fired doesn’t automatically invalidate NDAs.

People do it all the time because they don’t get caught or their previous employer has no evidence. But it’s absolute not just a legal thing to do especially if you have an NDA.

Even if non-competes were legal in CA, if you broke the employee contract by I dunno, firing people without cause, not paying their severance immediately, and not showing up to arbitration then you also nullified the non-compete
