im an amateur lawyer and if people are very stupid, then they lack the foresight necessary to be culpable under the law. there was just no way that that person who is extremely stupid could be held responsible for slamming an infant on the ground a bunch of times. i am of course citing dumbell v. moran which was a landmark decision regarding baby law.
