The actual argument seems to be down to "We don't have to prove anything, your honor can disqualify based on the appearance of impropriety" and then acting as if they have proven anything to establish that appearance.
They aren't doing a good job pretending.

If I were one of the people up on the RICO charged and watched this, I would be in at the DAs office Monday morning working out a plea deal before poo poo gets any worse. Of course, if they had any modicum of understanding of consequences, they wouldn't be there in the first place, but after this farce there will be no mercy from the prosecutors or judge.
