Yeah I don't think anyone except people that read it knew that Hammerhand came back a second time, given that Hammerhand does not even have a wiki article. Also I don't feel like searching over a decade of comics to check if Cyber-Tooth showed up.

I'm sure the cops that show up will definitely take all of that into account and not just accept a bribe to quietly make all of this disappear, especially in a strip set so close to Serpico's prominence.

Yates walks free, the evidence unusable due to being illegally obtained. Public opinion turns against Spider-Man due to verifiable charges of breaking and entering, assault, kidnapping, and robbery. Jameson vindicated at last!

Captain Hygiene posted:Yates walks free, the evidence unusable due to being illegally obtained. Public opinion turns against Spider-Man due to verifiable charges of breaking and entering, assault, kidnapping, and robbery. Jameson vindicated at last! A good defense attorney (and I assume Yates would have one) could probably argue that due to no reasonable chain of custody, and the likelihood that a spider man with a grudge could falsify evidence, it's not illegal for the police to use information provided by non LE entities. e.g. If a burglar robbing a house comes across CAI, they might call the police (from a payphone way away) and notify them of the CAI present. Because law enforcement wasn't the source of that tip, it would be entirely valid for a search that found the CAI to be used in court. At least, as I understand it. I'm not a lawyer, let alone a specialist spider law. E: a quick search implies that while police can use an anonymous tip, there needs to be more for probable cause. The police might combine the tip with other evidence to have enough to request a search warrant. For example, anonymously reporting that a certain building is being used for drug distribution isn't enough for a search warrant, but it could be enough to have an undercover officer hang out to examine traffic nearby and see if anyone stands out, or could provide a reason to attempt an undercover purchase. In this case, if the police show up to the lobby where their friendly neighborhood spider man hands them a folder labeled "My Crimes," they were given that evidence directly. It may not be usable on its own, but the financial information within could be confirmed which would then be relevant evidence. Volmarias fucked around with this message at 17:56 on Mar 19, 2024 |

Nah, Spidey has anti-karma. Whenever Pete is just going around trying to fight crime the world will have this rabid, murderous hatred for him and he'll be shot at simply for existing. On the other hand, if he does something very illegal or unethical the universe will bend over backwards to reward his lovely behavior. The worst that will happen is that he doesn't get to profit from his misdeeds.

Is it illegally obtained evidence? Spider-Man might be attorney general at some point, but he's not working for Law Enforcement right now, he's still a vigilante. E:fb.

Nice piece of fish posted:Was it illegally obtained by the police? Because it seems to me like they came into the possession of said evidence during an investigation into an unlawful detainment of two persons by some sort of masked vigilante, and did not themselves conduct any sort of unlawful search and seizure, unlawful arrest or anything. It would seem like the police could use the information as a basis for a reasonable suspicion requirement warrant and arrest, wherein they would be able to investigate and gather coroborating evidence. Waffle! posted:Is it a distinction between 'the evidence was stolen property and taken without a warrant,' or 'the police arrived to discover the perpetrators and evidence of their crime was in plain sight?' Devor posted:The line is whether Spider-man was acting as an agent of the government when he obtained the evidence. If yes, the exclusionary rule applies. If no, it would be admissible. Looks like it's totally fine for the Police to take advantage of some vigilante.
