fair dealing has different provisions and it's overly confusing so I'd understand why they'd err on the side of caution

Thanks for posting Lunar Maladies. I feel like the plot could've gone on way longer but I guess realistically it wouldn't be that hard to find a werewolf if they had an obvious tell and you knew it was someone from a fairly small group of people. And I'll second that the strength of that type of narrative lies more in the character exploration aspects rather than the actual hunting down a werewolf part, which Lunar Maladies did well

Is anyone keeping a record of a sort of the comics being posted? This is not a request or anything, I'm just kinda annoyed at myself because I haven't kept track of the ones I really enjoyed, so I know there will be absolute bangers lost to time just because my brain doesn't retain information good.

I think if someone's got a half-remembered comic the best thing to do is just post about it and someone else will have remembered enough to find it.

I typed up a whole thing here about how Fair Use is an just affirmative defense that has to be argued in court, which is what I learned in undergrad, but it turns out it's changed since then lol. In 2015 the US Ninth Circuit ruled Fair Use is a right. This could still be appealed and ruled on differently by the Supreme Court, but it's pretty cool.

That said, derivativeness or transformativeness isn't actually one of the criteria looked at when deciding if a work is protected under Fair Use.

quote:

Notwithstanding the provisions of sections 17 U.S.C. § 106 and 17 U.S.C. § 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include:

the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;
the nature of the copyrighted work;
the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
the effect of the use upon the potential market for or value of the copyrighted work.

These criteria don't provide any clear cut protection for mashed up derivative works like the comics grid, though I think we can all agree it is morally/ethically an original work putting it's own twist on the concept. Maybe it could be argued for commentary? I also don't think they clearly rule out the comics grid but it seems like it is a case where you'd have to go to court over it to get an answer.

Fair Use is pretty widely misunderstood and it's always good to know your rights as a creator.

In conclusion, at bare minimum the public domain should be dramatically expanded.

Thanks for posting Lunar Maladies & OA! The latter was extremely up my alley, as mentioned.

Regarding Souboutei: I'm glad the two protagonists figured out a way to fight against the self-guilt terror, but the next thing I'm really worried about is whether the already-possessed characters can be saved or if the possession is a permanent, no-coming-back-from-this thing. I'm sure we'll learn that in a bit.

I mean, the nameless soldiers, cops and firefighters are all donezo. The kind hearted military guy, he got blown up by the egotistical psychic warrior, so he's done. The science crew, probably all screwed. The three purifiers sharing one mind between them - probably toast. We haven't seen the hard rear end military woman or the wheelchair bound granny and her husband/servant since going into the paintings, but I doubt they get out of things OK.

Also the buff guy, he's not being tortured over some guilty thing he did, if I read correctly. He's re-living a nightmare where as a scrawny kid, he got trapped in a small metal box playing hide and seek with his buddies. So he's reliving a nightmare, but he shouldn't feel guilty about it. Unless I misread and he was part of the group and he unknowingly left his friend there trapped and alone in the dark.

Similar with scientist girl. She didn't excel and get over 100 on a test, so her dad whipped her with a riding crop. lovely behavior, but that was the dad's doing, really.

If Takoha can go into the katana girl's nightmare for moral support then I suspect they can do the same for the others and help them snap out of it. I doubt they'll be able to save everybody (even aside from the ones whose bodies have already been incinerated) but it would be an odd choice to introduce this concept to help save a single character and then never touch it again.

(As for the nature of the nightmares, see also the second part of Takoha's own nightmare: he was haunted by his father's dementia because it was scary to deal with, not because he felt responsible for it.)

It's a small thing, but I really like that Eddy's applause has more size variance and one really giant CLAP with rise and fall around it. It sells the idea of his supporters being more enthusiastic in a way that just making him get obviously more 'claps' or a clearly all-bigger font wouldn't, which instead might make it seem like Endo has absolutely less support.

In the examples we've seen, everyone surrendered to the nightmares, had their souls shredded, and were jettisoned from the portrait as eyeless spooky bodies. Takoha and Kurenai both barfed up the nightmare goop while inside the painting, while they're still in the nightmare realm. The way I'm reading it, the "possessed" are functionally dead, in that their soul was destroyed and it's something else entirely piloting their bodies.

I'm assuming this will be clarified eventually, but I don't think it's a plot hole for it to not work on anyone who has already been fully Souboutai'd.

It's not a plot hole either way, I just think it would be kind of an odd storytelling choice. They made a big point of establishing that the bodies are technically still alive. It's possible their souls are just completely obliterated but they might just be trapped in the paintings.
