He wasn't supposed to officially take it yet but he was still acting in the capacity (like doing that conference where he accidentally revealed that his "anonymous source" was Trump), so I'll count it. He might be the only communications director with an official 0 day count anyway, since he was officially hired and then fired before he was supposed to start.

Is it offensive to refer to trans people as "trickster demons?" EDIT: Sometimes laughing helps you not be angry about how unfair it all is. Let's look at some cats that are not happy about having been shaved. Ariong has a new favorite as of 00:30 on Aug 1, 2017 |

Subjunctive posted:It what? Holy gently caress that is some primitive, disgusting poo poo. Pretty much any defense is *legal*. You're allowed to say pretty much *anything* in your own defense. You can even claim multiple defenses which directly contradict one another. Whether a court and a jury accept it or not is an entire other matter. The number of cases a "gay panic" or "trans panic" defense has been raised in can be counted on the fingers of both hands, with some fingers left over, and the number of cases it's actually done any good in is comfortably lower than that. I don't think there's a single case in the US where it has led to an acquittal, or can reasonably be argued to have led to a lesser charge. Phanatic has a new favorite as of 01:54 on Aug 1, 2017 |

Just from the wiki page there were some examples from the 60s and 70s where people were convicted of voluntary manslaughter instread for 'did a big ole murder' I can't vouch for the validity but it doesn't seem to be unreasonable argue that it has led to a lesser conviction

funmanguy posted:Just from the wiki page there were some examples from the 60s and 70s where people were convicted of voluntary manslaughter instread for 'did a big ole murder' No, there aren't, not in the US section of that article. First case mentioned is from 1965, defendant was convicted of second-degree murder, which was the appropriate charge. Second case is from 1968, defendant was convicted of murder. Case from 1970, the facts of the case didn't support a charge of first-degree murder, which requires premeditation, and the appeals court *specifically rejected* the homosexual panic defense. 1975 case, defendant was found guilty of first-degree murder, then raised a homosexual panic defense on appeal, and was again convicted of first-degree murder. 1979 case, defendant was convicted of first-degree murder. "Did a big ole murder" is not always the appropriate charge for a homicide.
"Did a big ole murder" is not always the appropriate charge for a homicide.
The 1981 case where the jury went with manslaughter instead of second degree murder, then the appeals court ruled to throw out the manslaughter for a few reasons, one of which being not admitting testimony regarding the murder victims sexuality. Can't find any info about the retrial. That's the one I was talking about, but after digging through the appeal info, I don't think gay panic defense had anything to do with the initial verdict, and the appeals court set very tight limits on what is admissible when/how/why that I don't think it could possibly be a problem in the retrial. This poo poo is way more nuanced than I expected. Edit: oh right here is the appeal info https://www.courtlistener.com/opinion/1173218/williamson-v-state/ Sorry phone posting is hard
