If that's true, that'd be rape, and you're allowed to use deadly force to prevent yourself from being raped. The jury didn't buy it, and a retrial was granted because he wasn't allowed to introduce evidence that the victim was, in fact, gay, and that was ruled to bear on his defense. That's not a gay panic defense at all: the defendant in no way claimed diminished capacity because he found gay people so creepy. He claimed that he shot the guy to prevent becoming a rape victim. Of course, usually in a case of self-defense you don't go about trying to dispose of the body and concealing evidence.
