The law has to apply to everybody or it's not law. I would expect/hope that in justified cases like this they would get a lighter sentence, but they should still have to face consequences.

The one time in my life I got smashed, couldn't-stand-up, puke-spewing drunk, it was on martinis. I used to love olives, but they elicit a visceral vomit reaction from me now.
