That’s not what he’s suing over though. If you read the interviews he literally says that he uses the notoriety to his advantage. “I use it to hook up with hot chicks but then they dump me when they find out I don’t have any money!” He comes across like an rear end in a top hat in every interview. Now that being said, I do think he deserves monetary compensation beyond the $200 bucks his parents got but don’t make the mistake that he’s suing over potential CP; he’s suing over money and using CP as a cover.

It seems like his lawyer was just naming anyone who even looked at Nirvana in the 90s because Chad Channing is named in the lawsuit and he wasn't even in the band when they made Nevermind. A lot of people are giving this the side eye and it's not hard to understand that. If he is in fact co-opting the trauma of people who were exploited as kids he's a huge scumbag though. That said, I'm not ready to dismiss his claims and you can't really prove he doesn't feel exploited. In any case that album sold literally tens of millions of copies and remains hugely popular and the cover is on numerous t-shirts, posters, and other merchandise. For decades. Just give him some loving money.

I don't think it should be up to the victim whether the offending material is openly distributed or not, I don't particularly give a gently caress whether he's "ok" with it or not. His parents were at best misguided and at worst criminals of the worst order when they agreed to this hth

The picture was taken by his dad's friend. The guy called the dad and said he was taking pictures of babies that day and offered 200 bucks to throw his kid in the pool so they could take pictures. According to Elden his parents didn't give permission to use the picture for an album cover and weren't asked for permission. A lawyer might be able to make that an insignificant matter though because a lot of times when you're the subject of a photograph the photographer has sole ownership over the way its used and the picture itself. Whether or not that was agreed upon by the parents and the photographer I don't know and if there was nothing in writing, which is likely in this case, it gets murkier from there.

Yeah, any sensible photographer will get all their model releases signed and filed away in a very safe place in case anything like this comes up in the future. (The exception being that guy who took the photo for Vampire Weekend's Contra, who seems to have been a bit of an idiot.)

Typically the object of a lawsuit is to get money as compensation for some sort of wrong done to a person, so yeah that's kind of the point. At this point it's literally impossible to take that image out of circulation.
