It seems like his lawyer was just naming anyone who even looked at Nirvana in the 90s because Chad Channing is named in the lawsuit and he wasn't even in the band when they made Nevermind. A lot of people are giving this the side eye and it's not hard to understand that. If he is in fact co-opting the trauma of people who were exploited as kids he's a huge scumbag though. That said, I'm not ready to dismiss his claims and you can't really prove he doesn't feel exploited. In any case that album sold literally tens of millions of copies and remains hugely popular and the cover is on numerous t-shirts, posters, and other merchandise. For decades. Just give him some loving money.

According to Elden his parents didn't give permission to use the picture for an album cover and weren't asked for permission. A lawyer might be able to make that an insignificant matter though because a lot of times when you're the subject of a photograph the photographer has sole ownership over the way its used and the picture itself. Whether or not that was agreed upon by the parents and the photographer I don't know and if there was nothing in writing, which is likely in this case, it gets murkier from there.
