I work in probation Intake, and had a novel question from an offender this morning. He was just sentenced after pleading to a felony, but had voted before the plea. Does the status get counted on election day, or at the time of voting? I doubt I'll see him again, but it made me curious. I'm not an agent, and the one agent I asked said she wasn't sure either. (I deflect all touchy questions as I'm not trained in the details).

Edit: Just got an answer from elsewhere, but it was interesting so I thought I would share. Voting precinct staff person I know said our state (WI) doesn't technically have early voting, it has in-person absentee voting. His ballot will be checked against a register of ineligible voters and discarded, as it is processed by staff. Not sure if he could/would be charged with fraud, as he was not ineligible on the date submitted.

One of the sad/ironic things I am tasked to do is have 17 year olds on adult probation sign that Voter Ineligibility form. Youngest person I've processed in adult probation was 15.

Something we were discussing in the office this week... We had a client with (supposedly) 8 children with 5 different moms. First time I have seen a judge write special probation orders to take a class in Birth control.

How does court ordered child support work when there are that many Payees? Every kid gets a check for 10$, or some sort of order of need/1st in, first paid thing?

Comedy note: He really didn't know the term birth control. I explained it meant using a rubber to not have more kids. Garnishing unlikely, too as his conviction was Possession w/ intent Coca.

It's Wisconsin, and it was a class, not 'use'. In probation, as part of the plea, and orders of the court, I regularly copy down specifics like 'not to be in any resale shops' 'not to be within 3 blocks of _____ street', 'Agent to do random searches of home and car for weapons'. I also see 'no physical discipline of any child' way too often. The big, standard boiler plate stuff is covered by one of 3 sets of standard rules, Domestic violence, Alcohol and drug, Standard, supplemented with sex offender rules.

Anyway, didn't want to derail, and I'm not even an agent, was just curious how max garnish worked on a flock of kids in different households.

At least locally to me, crime of drug dealers against other dealers or customers has gone up lately. I doubt the property would be returned, but charges like theft and armed robbery do get filed. (Source - I work in probation and see the details of the complaints).

At least for our PD, they seem to want to focus on the type of people who beat people up, break down doors, or worse. We still have a fair amount of shootings where the victim claims 100% ignorance, better to be injured than snitch...

Just had someone refuse to sign his felony paperwork for probation: reason? He's an election judge, representing himself pro se, of course! So he pleads to a felony, but refuses to acknowledge it because it would "Deny him income".

11 counts of felony failure to pay child support. All but 2 dismissed.

I hope states share felony lists (he belongs to the neighbors). Anyone know if that data hits a national database?

Attended a very interesting/scary corrections seminar on Sovereign Citizens (focused on Wisconsin) last fall and they mentioned an upswing in a lesser known Sov Cit group. Moorish Science Church is an african american group that recently has been successfully branching out into real estate here. Basis: they are the original settlers of North America as a lost tribe, thus they own the land because unlike the Native Americans, they never ceded their rights away.
So.. they find empty homes in foreclosure, which as banks are not Flesh and Blood men, they create titles to after changing the locks, and rent them out. Their land, 'unowned' homes... when the tenants eventually are discovered by the banks and evicted, the 'landlord' is seldom pursued by the banks. The time vs reward of dealing with litigation crazies is not worth it to them.

This came up at my work. Can a juvenile adjudication convicted person for a serious crime (I work for a state Sex Offender Registry) own a gun? Does they count as felony? We tell people 'seek a professional legal opinion'. Curious if there is any consensus.

Yep. I asked our specialist in office (like a probation agent for Registrants) and she said there is not a clear answer. Even more comedy is the Feds at NCIC calling us about it... Because, as you said, states do stuff differently. I. This case, it was a juvenile adjudication person, worried about cre in his neighborhood... It's a weird part of the job, sometimes putting people born as recently as 2004 on for life. (Hidden though from public, as juvs though).

Dumb question, but how do you get chosen to even be considered for a jury? I was told as a teenager, it was from registration to vote. I'm 45 and have never, once been contacted. Friends have been called multiple times. Even had a friend in a major news (cop shooting) jury trial. Do I just not exist or something? I vote in every goddamn election.

Both places I have lived since my majority, have been state capitols. Lots of trials, including Fed.

I had a past job in Corrections with the Sex Offender Registry, so I have read stupid amount of pretty extreme criminal complaints, I am curious if they wouldn't want me. But it feels like I will never know...

Helping my sister with her Disability case (she is in MN). I am fairly sure she is a solid medical qualification*, and we finally got the expected initial rejection for the Social Security administration. Any idea on the 'normal' appeals process time? I found her a lawyer a year ago and it took 7 months after SS received the application packet to reject. The lawyer is taking her full pro Bono, no cut, as she has had no income since March of 2020. Her accident was October of 2020.

Completely supporting her rent, food, utilities now for over a year, and I would love to know when/if I can expect to see the light at the end of the tunnel. 1st appointment for appeals is in 2 weeks.

*She broke her damned neck tripping up stairs, and has had two spinal fusion surgeries. I am supposed to be the clumsy one, SHE took ballet!

What are her current symptoms? I assume chronic pain? How's she being treated?
After the first emergency spinal fusion, she had no followup, no PT, and things got bad (she's on MN-Caid). After a year and a half, she had more spinal cord swelling, and lost feeling in her feet, and a MRI showed 'whitening' of the spinal cord, ie, oops, that doesn't grow back, so she had the 2nd surgery 2 weeks later. At this point, she can walk with 2 leg braces, 2 arm braces, is able to tell when she needs to pee (she was losing that ability, which is what got her triaged to the MRI). She can't tell where her feet are, so her balance is pretty bad, and scores 30/56 on some fall risk thing. She can't lift anything more than about 10lbs, and has a lot of fair bit pain - but she's also very allergic to any opiates so she gets tylenol, some NSAIDs, and at least initially after surgery she had inject-able Torodol, a sort of super NSAID. Her apartment is 14 steps in the front, like 10 in the back, but $600 a month so that's hard to beat. I'm going to try to schmooze the landlord this summer into letting us/community try to get some ramps at least up to the back, but I don't think she can stay there long term.

She has PT a couple times a week, one in home, another at a nice hospital in the burbs. She spent the last 25 years as a bar cook, and has a GED. I could see her being physically able to do an office job, but she's uh, not mentally well suited. Smart, but no ability to jump through hoops, not speak her piece, or tell someone to go gently caress themselves. Also dealing with a lot of depression as a result of her life exploding, and no real job prospects. I wish I could move her closer, but cost of living is a lot higher where I am, she'd have no friends, the only real perk is I could do daily activity stuff like laundry for her. She's 4.5 hours drive away :smith:

Took some trainings at a previous job Re: sov cits, as Wisconsin has a lot of them. They are known to pull poo poo like bogus leans on court or lawmakers homes, also to just declare they own property, because people (not banks) can only own property. So if it's unowned, I dunno, it's like legit salvage? The logic is wild.

In any case, they break in to bank owned property, change the locks, rent them - a month or two later the 'tenant' is tossed out as a trespasser.

Also, there is a local Midwest variation, who base their sovereignty on the fact they are a lost tribe from the bible, and got here before Native Americans, so you know, they own everything. (Notwithstanding the fact that logic didn't help Native people all that much. Moorish Nation, who are largely African American. They give paid information courses, as a scheme to earn money from ignorance. So, not ALL crazy white nationalists.

Being active in a union, we (AFSCME) have never had more inquiries about how to unionize workplaces. Successful ones too - a Sourdough bread bakery (80 employees), a game store just in the last few months. Others have been working on getting contracts, the Wisconsin Red Cross nearly struck, and management caved. Getting rules out in writing is good for both sides, and makes for stable workplaces where people stick around. The low unemployment rate helps negotiation.

Question: what sort of lawyer would I look for, to set up a trust for a family member who is in the middle of the (long and stupid) Disability appeal process? Also hoping to get State specific legal advice on how I can help her out without it counting as income, and possibly counting her as a dependent. I'd only do that if it didn't screw her (I am not worried about my taxes). Is this a 'family law' thing, or should I look for a disability law one?

Backstory - sister broke her neck in late 2020, and had not worked since March due to covid, and the restaurant industry.
I want to make sure if she does get money (she's my beneficiary) it won't screw up her case, but also she's terrible with money, so longer term, it could be helpful. She has some mental health issues, and when stressed, just refuses to think about/address bills. I have no kids and a partner that makes 2x what I do, so trying to estate plan with her in mind. Also thinking about buying a house and renting it to her if/when the stupid disability process concludes. We have been told 9-15 months more for the admin judge review - got her a lawyer already for that process.

My work has the 'you can clock into work up to 15 minutes early ' but you are not allowed to do work, just gear up (boots and high viz) until 7am. That's because we have 2 time clocks and 95 people. Extremely regimented clock out, allowing overtime or comp for every minute over your end of day, PLUS 10 minutes wash up time. People come in, and loiter in the hall, because you are not allowed to leave the lot until your end of day. All of this negotiated by the Laborers union.

I have a not quite dog level of smell (but pretty good) and I have absolutely driven by or behind cars, with all my windows up, and smelled weed. At highway speeds. Considering how much those dogs/training costs, they better be signalling some of these.

I am all for people smoking up or drinking *in a responsible place* but I would really appreciate stoned people being pulled over/off the road, just as much as drunks.

Actual legal question: I have gotten through the dual citizenship (with Ireland) process to be declared a Irish Citizen born abroad, and have a weird certified birth certificate thing. Any idea how much the next step with a presumably immigration lawyer would cost, to get a EU passport? I did the first part with a very confused University legal service attorney like... 20 years ago. I have never hired a lawyer for.... Anything? I have zero ideas on what that sort of thing costs. (In Wisconsin, if it makes a difference). No emergency timeline, I just want to do it, and I am approaching being grown up and debt free in a few months. Red passport cool kids club.

In Wisconsin, one of the paperwork bits an agent is supposed to do at the end of probation is a procedure where any criminal restitution is converted to civil. There are times where if you do good, and pay back what you owe, you can get off early.

Another big thing is (unless this has changed, which it might have) your voting rights are suspended until you pay back the victim in full. I'm (thankfully) about 7 years out of date from working in probation.

I thought the ability to go for the appeal hinged on being able to put up a bond? Like, that was a criteria for it? (I very well could be wrong). So if didn't put it up, it would be the original judgement stood?

Video games have taught me people keep large amounts of cash and gold on bank safe deposit boxes.

I doubt anyone remembers, but several years ago I asked questions here about getting a lawyer for my sister, for her Social Security Disability application. After applying, denial (7 months wait), filling an appeal, waiting another 15 months, a hearing... Her disability starts in April! Total time about 2 years. (She broke her neck, and is now a partial quad)
Hind sight is I wish we could have started the process when she was living off her GoFundMe. I had no idea it was so slow. A Minnesota disability resource center found us a lawyer that won't take a cut of the checks, too! They even did a practice hearing with her so she wasn't surprised by questions during the administrative appeal.

My best stolen car story is when I lived in NoCal, and dumbass teenagers stole our piece of poo poo 20+ year old Pontiac. Not sure where they were going, but they instead got picked up walking along a Nevada desert highway, no water or sunblock. Car had died. Pretty sure the gas gauge was iffy.

Didn't get the car back though :(
