It's not a "because" situation. N52 Earth-1 is presumably the Earth most books take place on. Earth-2 is the one Earth 2 takes place on. Earth-3 is something of a traditional name for the Earth where everyone is evil, so they went with it for Forever Evil.

"Exclusivity" just means "you can't work for DC/Marvel while working for Marvel/DC." These agreements have never stopped anyone from doing creator-owned work published by other companies. Letter 44 shouldn't be affected at all.
