 There are several guides on how to play Diablo 2 on Mac without using BootCamp. I don't know if anything's changed with Mac OS since I've last tried, but I've had success using both PlayOnMac and Wineskin. PlayOnMac tries for a more user-friendly experience, so provided it can be configured to access battle.net in 10.8.5, that's what I'd recommend trying.
