No, but it is a hate crime! Assuming Italy/the EU has hate crimes. And that the crime was committed under Italian jurisdiction and not Libyan. Actually they were probably in international waters so no crime was committed. They should all be able to go free and claim asylum to live in Italy forevermore (or move up north.)
