We see this all the time with all sorts of activities that require the signing of waivers which then become absolutely useless when it comes out that someone hosed up in a terrible way and it lead to a major injury or death. This is a common lovely discussion tactic, not just for lawyers. If you can't make a real argument you look for technicalities you can use to try to make the opposing argument look bad. It's a pretty lovely move to pull in casual discussion on an online forum.
