It would appear that only transgender people who have completed "sex reassignment surgery," as it is described, would be considered transgender and entitled to "a certificate of sex reassignment."

"The draft bill," WBTV adds, "also amends portions of HB2 related to protections for employees by adding specific references to federal statutes that provide special protections for certain groups of people. Other changes in the draft legislation increase the penalties for suspects convicted of committing certain offenses in a multi-person bathroom or changing facility."

Bryant, stating "issuing a marriage license to a gay couple is not like being forced into armed combat or to assist with an abortion," speaking to the State's argument that irreparable harm could come without HB 1523. "Matters of life and death are sui generis. If movants truly believe that providing services to LGBT citizens forces them to ‘tinker with the machinery of death,’ their animus exceeds anything seen in Romer, Windsor, or the marriage equality cases."

Gov. Bryant will have to decide if he wants to appeal the ruling to the Supreme Court.

UPDATE:
The conservative legal organization, Alliance Defending Freedom, is providing co-counsel for the governor's appeal in the 5th Circuit. HB 1523 was based, at least in part, on language from a model policy that ADF sent to the governor's office before same-sex marriage was legalized nationally in 2015."

Treating trans people with respect and letting them use the proper bathroom isn’t a good treatment for gender dysphoria. (p35)
Gender dysphoria goes away once puberty starts. (p36)
Any harms to trans people are outweighed by harms to non-trans people. (p37)
Even if a trans person is harmed by anti-trans policies, just being trans is harm enough and they’re already suffering, so harming them more is ok. (p37)
Since “gender identity” isn’t real and only “biological sex” is, HB2 doesn’t discriminate against transgender people. (p44)
Since non-discrimination laws that mention gender identity have never passed Congress, we don’t need to worry about it. (p46)
None of this applies to Title IX since external genitalia is the only thing that matters in determining sex. (everywhere)
North Carolina’s brief goes from bad to worse to absolutely disgusting and can be summed up in one sentence: The idea of transgender people messes with what we think our world is and that scares the crap out of us, so it’s bad and wrong.

Note that the signatories of the amicus brief have no qualms about the taxpayers of Texas paying for a "vast array of benefits" for different-sex spouses.

"Indeed, it would unnecessarily implicate constitutional issues of state sovereignty if Obergefell were misconstrued as imposing spending requirements on the state of Texas to fund expensive health care and other benefits without authorization by Texas law," they claim.

The lawmakers and others who signed the brief call on the justices "to diminish federal tyranny and reestablish Texas Sovereignty," by denying these same-sex couples spousal benefits.

Remember: You are talking about Conservatives that defend parents who starve/beat their children for not being proper, good Missionary position Christians. They protect people that allow their children to die tortuous diseases because "Prayer will save them"

They would rather their child die than be gay or not Christian. Think about that. The very group that says Abortion is Murder is okay with murder when it defends their wacky religious ideals.
