The Gawker folks were such assholes during the proceedings that I'm pretty sure they'd have lost a jury trial anywhere in America. Once you say you'd publish a sex tape as long as nobody involved was under four, you're practically begging the jury to light you the gently caress up.

At the time Gawker obtained it they (plausibly, anyway) didn't know it was stolen, and Hulk Hogan couldn't have really proven it was. In fact, Gawker wouldn't have even had reason to believe Hulk owned the video, since he wasn't the one filming it. (It was 100% stolen in the case of the fappening, though, since the people who released the pictures were the ones who stole them and they were open about them being hacked from the get-go) Money made this case happen. You're not going to get a bunch of people to crowdfund a case against a media outlet for smearing a celebrity. Though, if you could, how horrible would that be? How much money do you think Chris Brown's fans could have drummed up to sue the pants out of the literally hundreds of media outlets that spent months going just past the point of reasonable about how much of a terrible loving person he was? Peter Thiel made an implausible lawsuit happen because money. Gawker threw their chances away deliberately like loving morons and deserve what they get for it, but the whole case is dumb and I don't like the precedent it could set for the future.

Posting a sex tape, as in the actual sex tape for everyone to see and not just reporting its existence: ok and newsworthy, especially since Hogan couldnt *prove* it was stolen. It could have come from anywhere! And we all know that if a victim can't definitively prove their victim status, the only right thing to do is leave the sex tape up until a judge orders you to take it down. This is a valid use of journalistic license and an ok thing to do. This is a thing you actually believe.
