This was in Oklahoma, and the Oklahoma Constitution prohibits it, regardless of what the First Amendment says. The state supreme court struck it down before the lawsuit even went to the feds. Oh, and it gets better. The congressmen who wanted it up decided to amend the state constitution, which would send it to the feds (and be a waste of everyone's time). To amend the state constitution, you need to put it on the ballot. It got shot down. Pretty solidly, too. (You'd think they'd have gotten the hint after the third time someone ran it over with a car.) So, no Ten Commandments (and no totally awesome goathead statue, either).
